  2. Overview • The process of regulatory change – Evaluation, Consultation, Drafting • Amendments to Public Reporting • Amendments to Government Reporting • The Assessment Framework and Assessment Plan • Transitional Arrangements • Recognition Scheme

Evaluation – Recommendations • Subsequent to the review, the Full Cycle Evaluation made four key recommendations; • Complete the second full EEO Program cycle; • Improve the flexibility with which corporations meet compliance requirements, including alternative compliance mechanisms; • Provide greater clarity on required compliance requirements and which aspects of EEO compliance are flexible and open to negotiation; • Improve outcomes and reduce compliance burden through whole of government approach to policy, streamlining of compliance obligations and harmonisation of reporting methods

The Government’s response • Proposal to amend the EEO Regulations • Reporting • Assessment Framework • Recognition of energy management • Scope informed by discussions between Department and EEO participants (EEO Workshops, ISO’s) • Why now? • Provides scope for 2005-06 trigger year companies to apply changes immediately to their 2nd cycle assessments • Allows 2006-07 trigger year companies to incorporate into 2nd cycle Assessment plans

The Consultation Process • National Workshops on Proposed Changes • Submission Papers on Proposed Changes • Release of the Exposure Draft Regulations for comment • Final Regulation Amendment drafting • Regulations tabled and effective from 8 August • Ongoing consultation with participants and Industry Associations

Publicreporting • Response to Recommendation 2 of Full Cycle Evaluation – alternate compliance mechanisms • Changes seek to: • Simplify the mandatory reporting requirements of the EEO Program • Allow for better public communication of assessment outcomes • Facilitate the integration of annual public reporting into existing corporate reporting methods and timelines • Changes do not remove requirement to present information to corporate boards

Assessment Framework Changes • Response to Recommendations 2 and 3 of Full Cycle Evaluation: • Greater flexibility in how the assessment framework is applied • Distinction between required compliance standards and areas of flexibility • Changes seek to: • Provide corporations with greater flexibility as to how they meet the intent of the EEO Assessment Framework • Simplify and reduce the information needed for key requirements • Remove areas of duplication and requirements that do not add value

Assessment Framework – Streamlined Requirements • Removal of Guidance Section in the EEO Regulations • Streamlining former key requirements: • merging 2.1 and 2.2 • merging 5.1 and 5.2 • merging of 3.2 and 3.3, into a single action • Terminology changes • Key Elements / Requirements and Key Requirements / Actions • What does the change mean? • Alignment to the EEO Act • Greater clarity on expected actions • Ability to seek approval for an alternative Action

Howwill this process affect existing participants? • Effective after 8 August - NOT RETROSPECTIVE • Companies can continue with current actions • No requirement to change • Approved 1st or 2nd cycle Assessment Plans can remain in place • No additional compliance obligations • Corporations interested in accessing the new, more flexible arrangements are encouraged to contact their Industry Support Officers (ISO’s)

RecognitionScheme • Response to Recommendation 2 of Full Cycle Evaluation – providing alternate compliance mechanisms • Initiative seeks to recognise corporations that have excellent energy management systems and processes • Not just about having a good assessment plan • Energy management embedded in business culture • Internal processes and systems meet and exceed EEO Program requirements • Recognised corporations able to: • Base their assessment on their own processes and systems rather than complying with specific requirements of the EEO Assessment Framework
