Objectives • Industrial facility Owners recognize the benefits of Contractor Employee background screening to identify individuals that may pose risks to people and assets through behavior that may cause serious safety incidents, workplace violence, domestic terrorist acts, and theft of materials, equipment or technology. • This Program will apply to Contractor Employees providing maintenance, construction and operational support services at participating Owner sites. Each Owner will define the target workforce at their facilities. • A fair and objective standardized Contractor background screening process is being developed that includes identity verification, criminal background review and terrorist watch list screening that will promote a safe and secure working environment for both Owner and Contractor personnel and will minimize incidents that may affect the surrounding community.
Key Program Features • Will comply with Fair Credit Reporting Act (FCRA) • Modeled after HASAP (now known as NASAP) • Consortium established between Houston, Baton Rouge and New Orleans area Owners • Written program approved by Owners • HASC will be the "Program Custodian" • Includes a graded method of categorizing a Contractor Employee's background screen results (grades 0-7) • Owners participate voluntarily and establish their own site access requirements (maximum background screen grade)
Key Program Features • Contractor Employers will have a choice of several approved Third Party Administrators (TPAs) to perform the background screens • A background screen grade will be determined by the TPA for each Contractor Employee and transmitted to the Program Database, maintained by HASC • Contractor Employees have the right to dispute the initial background screen results • Contractor Employee's background screen grade will be portable if they change employers or begin working at another Owner facility • Owners will only be able to see if the Contractor Employee is Active or Inactive in program – for their site
Criminal Screening Criteria • Background screens are completed using standardized background screening criteria and methodology • The best available national criminal databases will be used • Federal, State and County court house records will be checked in all identified areas of residence and employment (when known) • All convictions occurring during past 7 years and any conviction related to a prison release date within past 7 years will be considered relevant for purpose of developing a background screen grade • The background screen report will only be given to the Contractor Employer and the Employee • A new background screen is required after 2 years
Criminal Screening Criteria • Screen results will be graded 00, 01, 02, ….07. Each Owner will decide what grades will be allowed on site; 00 Clear Record 01 One or more “non-violent misdemeanors” 02 One or more “violent misdemeanors” 03 One or more “lesser felonies” were found. 04 One or more “violent misdemeanors” and one or more “lesser felonies” 05 One or more “higher felonies” were found. 06 One or more “higher felonies” and one or more “violent misdemeanors” 07 Patriot Act List
