  5. What Federal law effects meal modifications? ADA Act of 2008 both physical and mental impairments can constitute a disability. All program SBP, NSLP, ASP and FFVP need to comply

  6. Types of Disabilities Food Allergies- Both life threating and non –life-threating if it impacts a bodily function or major life activities. Food Intolerance- Case by case but if it limits major life activity it is a disability. Autism- could be some only eat certain foods due to behavior patterns. Temporary Disabilities Remember any limits on major life activity may be considered a disability.

SFA’s can choose to request written medical statement form a State licensed healthcare professional SFA can receive reimbursement for meals served to children that do not meet Program meal patterns IF a written medical statement is on file. How often do you have to update medical statement? Communication between SFA, nurse, cafeteria manager and staff

  8. What is “reasonable modification”? Peanut allergy, no foods containing peanuts or as an ingredient What's not reasonable? Request for brand name unless it is medically necessary Can larger portions of food be medically requested? Can smaller portions of food be medically requested? Can students that do not have allergies eat at a allergy free table?

  9. Will SFAs receive additional reimbursement to cover the costs of providing modified meals or accommodations to the meal service? No. SFAs will not receive additional reimbursement to cover the extra costs sometimes associated with providing a reasonable modification; however, SFAs may use funds from the non-profit school food service account, the general fund, or special education funds (if specified in the child’s IEP) to cover the additional food or food service costs.

  10. Food Preferences- Religion Vegetarian Both are choices Meals must follow program regulations.

  11. How does you district choose menu items? • How many ethnic dishes are offered? • What type of ethnic dishes do you offer? • Does your district offer vegetarian or vegan? • Does your district modify menus for religion?
