CARACPast - Present - Future • For almost 2 decades CARAC has been committed to building stronger relationships and stimulating healthy conversations with our stakeholders by consistently exploring new ways of consultation. • Let’s take a look at what is working well, what challenges are being faced and how we would like to set the stage for the future.

  3. What is working well • CARAC has been identified by central agencies as a best practice with respect to openness and transparency. • CARAC has had a simplified rulemaking process for many years to amend airworthiness standards quickly to allow for timely harmonization with the Federal Aviation Administration (FAA) and the European Aviation Safety Agency (EASA). • As a result of the reorganization within Civil Aviation, the consultation forums (known as Technical Committees) have been reduced from nine to one. • This streamlining has resulted in improved horizontal integration of rulemaking issues which, in the past, had been dealt with in a functional and silo-based approach. • Most importantly, we have a strong relationship with our industry partners.

Challenges • Timeliness – a regulatory proposal, on average, takes up to five years to promulgate once it leaves the CARAC table. • Tendency to focus on wordsmithing of initiatives rather than on the policy objectives during Technical Committee deliberations. • The timing and availability of evaluation of impacts of initiatives. • Process that lends to an endless loop (death by process). • Tackling the backlog of amendments currently in the system. • NPA database where information is difficult to find.

Objectives of Modernization of CARAC • The CARAC Modernization Project will make the rulemaking process: • more responsive to safety regulatory initiatives; • more efficient for industry and Transport Canada (TC) by streamlining and reducing process burden and; • more effective by prioritizing issues earlier with greater analysis at the outset (right people meet at right time on right issues). • This modernization activity is a top priority for Transport Canada Civil Aviation (TCCA). • Changes will be designed and implemented in phases and stakeholders will be involved from the outset.

Short Term Plan - Summer 2011 to Spring 2012 During summer 2011, informal one on one discussions with most key industry association stakeholders to solicit input on current situation and modernization approach and reinforce TC’s intention to maintain transparent and collaborative rulemaking. Launched pilot project to expedite rulemaking process for two sets of recommendations from the Transportation Safety Board of Canada (TSB). Modernization Plan

Modernization Plan (cont’d) • Medium-term Plan – Fall 2011 to Summer 2012 • December 2011 – Outreach to key stakeholders to identify areas of improvement and potential approaches to meet needs: • Strategic discussions, long term industry trends; • Additional goals: • Involvement mechanisms; • Timeframe for decision-making; • Scope and clarification of roles during consultations; • Discuss criteria in the use of an expedited rulemaking process. • January 2012 - Preliminary results from interviews with stakeholders. • February 2012 - Draft consultants report and launching of a questionnaire to all CARAC members. • March/April 2012 – Distribute proposed CARAC model for comment, which would include the expedited rulemaking process. • Spring 2012 – Complete review of TCCA internal processes, blockages, dependencies as they pertain to rulemaking. • Summer 2012 - Revalidate rulemaking amendments currently in the system awaiting drafting and publication.

Modernization Plan (cont’d) Long-term – Summer 2012 and beyond • Fall 2012 – CARAC Plenary meeting to endorse a new modernized CARAC process. • Amend CARAC Management Charter and Procedures to reflect the modernized process. • Develop realistic 3 year regulatory plan (including regulatory initiatives put in abeyance which have been revalidated). • Review regulatory resource requirements under new process.
