The Bill of Rights • 3rd Amendment: • 1. No soldiers can live in your home without your permission
The Bill of Rights • 4th Amendment: • 1. Nobody can search your house, car, or personnel property without a search warrant. • 2. Officials must have probable cause – (enough evidence) – to have a search warrant
The Bill of Rights • 5th amendment: • Deals with Criminal cases • 1. Nobody will be charged with infamous crime unless enough evidence has been brought to a grand jury. • 2. In time of war, like terrorism, the above right can be cancelled.
5th Amendment • 3. You can not be tried for the same crime twice – double jeopardy. • 4. You do not have to testify against yourself in court. (I plead the fifth) • 5. Every citizen has the right to due process of law – to go through the court system. • 6. Private property shall not be taken without just compensation. (eminent domain)
The Bill of Rights • 6th amendment: • 1. The right to a fair and speedy trial. • 2. The right to have a jury of your peers. • 3. You must be told why you were arrested. • 4. You have the right to an attorney.
The Bill of Rights • 7th Amendment: • Deals with civil court cases • 1. Allows a jury to be used if the amount exceeds twenty dollars. • However, Small claims courts now cover cases up to 5,000 dollars. (no jury). • If it exceeds 5,000 then a jury can be used to determine guilt.
The Bill of Rights • 8th Amendment: • 1. The bail must fit the crime – no excessive bail. • 2. The fine must fit the crime – no excessive fines. • 3. No cruel or unusual punishment.
The Bill of Rights • 9th Amendment: • 1. Rights retained to the people. • Some people feared that since the Bill of Rights didn’t list all your rights then the ones listed may not be protected. This amendment protects those rights.
Bill of Rights • 10th Amendment: • Allows the states to make their own laws that are not mentioned in the Constitution.
