The Central Board (EPF) has launched a special campaign from 01.01.2017 to 31.03.2017 to enroll left out eligible workers for bringing them under the social security umbrella of EPFO. FAQs 1.What is Employees’ Enrolment Campaign, 2017? ThisisaCampaigntoprovideopportunitytotheemployerstovoluntarilycome forwardanddeclaredetailsofallsuchemployeeswhowereentitledforPF membershipbetween01.04.2009to31.12.2016butcouldnotbeenrolledforany reason.TheCampaignaimstoextendPFbenefitstoemployeeshithertodeprivedof PFbenefits. 2.Whocanbedeclaredamemberbytheemployer? UndertheCampaignonlysuchanemployeecanbedeclaredformembership- (i)whoisaliveand (ii)whofurnishesForm11totheemployerand (iii)whowas required or entitled to become member of Employees’ Provident Fundonorafterthe1stdayofApril,2009butbeforethe1stdayofJanuary, 2017butcouldnotbeenrolledasmemberforanyreason. 3.WhetherInternationalWorkerscanbedeclaredundertheCampaign? No.TheincentivesareavailableforenrolmentofIndianNationalsonly. 4.Whatincentivesareavailabletotheemployer? Thefollowingincentivesareavailabletotheemployer: (i)Theemployee’s shareofcontributionifdeclaredbytheemployerasnot deducted,shallstandwaived. (ii)Thedamagestobepaidbytheemployerinrespectoftheemployeesfor whomdeclarationhasbeenmadeunderthiscampaignshallbeattherateof Rupee1(one)perannum. (iii)Noadministrativechargesshallbecollectedfromtheemployerinrespectof thecontributionmadeunderthedeclaration. 5.Whetheranyinspectionshallbedonetoconfirmthegenuinenessofthe declaration? 6.Whetheranemployeragainstwhomacomplainthasbeenmadebythe employeesisalsoeligibleformakingdeclaration? Yes.However,thedeclarationshallbevalidonlyinrespectofemployeeswhoare aliveandonlyifnoproceedingsunderSection7AoftheActorunderparagraph26B of the Employees’ Provident Funds Scheme, 1952 or under paragraph 8 of the Employees’ Pension Scheme, 1995 establishment/employertodeterminetheeligibilityformembershipofsuch employees. have been initiated against their 7.Whatisthetimelimitformakingthedeclaration? No.Thedeclarationsareonvoluntarybasis. 10.Whatisthetimelimitformakingtheremittancesonceadeclarationhas beenmade? Thetimelimitformakingtheremittancesonceadeclarationhasbeenmadeis15 daysfromthedateofdeclaration. 11.Whathappenstothedeclarationifaftermakingdeclarationtheemployer doesnotmakeremittance? Iftheemployerfailstopaywithin15daysofthedateofmakingthedeclaration,the dues,interestanddamagespayablebyhiminrespectofthedeclarationmadeunder thiscampaign,suchdeclarationshallbedeemedtohavenotbeenmadeunderthis Campaign. 12.Whetherdamageswillbeleviedlaterontheamountremitted? No.Thereisnorestrictiononthenumberofdeclarationsthatcanbefiledbyan employer. 16.Isthereanyrestrictiononthenumberofemployeesthatcanbeenrolled underasingledeclaration? No.Thereisnorestrictiononthenumberofemployeesthatcanbeenrolledundera singledeclaration. 17.Whetheronlinefacilityisavailableformakingthedeclaration? Yes.Facilityformakingthedeclarationonlineisavailable.However,documentary declarationcanalsobefiledwiththeconcernedRO/SRO. 18.Howistheamountofcontribution,interestanddamagestobepaidafter makingthedeclaration? ContributionistoberemittedasasupplementaryECRsforeverymonthofthepast periodenrolmenttillDecember,2016.Simpleinterestattherateof12%perannum anddamagesattherateofRupeeoneperannumarealsotobepaidthrougha separateECR. 19.WhetheritisnecessaryfortheemployertotakeForm11fromallthe employees? Yes.DulyfilledinForm11shouldbeobtainedbytheemployerfromallthe employeesbeingdeclaredundertheCampaign.Adeclarationtothiseffectis includedintheDeclarationFormtobesignedbytheemployer.Thedeclarationgiven intheDeclarationFormmaybeacceptedifitisdulyfilledinandsignedbythe employer. http://epf-india.co.in/

No.AnemployeecanbedeclaredundertheCampaignonlyifheisaliveonthedate ofmakingthedeclarationandForm11dulyfilledwithsignatureorthumbimpression oftheemployeehasbeenobtained.Therefore,anemployeewhoisnottraceable cannotbedeclaredundertheCampaign. 21.Whethersuchpersonswhoweretobeenrolledasmemberbutdiedbefore 31.12.2016canbeenrolledasmembersunderthecampaign? No.AnemployeecanbedeclaredundertheCampaignonlyifheisaliveonthedate ofmakingthedeclaration. 22.WhetheranRPFCcandenythedeclarationsayingthattheyhavenow decidedtoinitiateinquiryundersection7AofEPF&MPAct,1952even thoughtherewasnosuchinquirypendingagainsttheemployerason 31.12.2016? Declarationmadepriortoinitiationofinquiryundersection7Ashallbelegallyvalid andcannotbedeniedbytheRPFC.Onceanoticeundersection7AoftheActis issued,declarationcannotbemade. 23.For the purpose of Employees’ Enrolment Campaign, 2017whenisan inquiryundersection7AoftheActtreatedasinitiated? For the purpose of Employees’ Enrolment Campaign, 2017 an inquiry under section 7AoftheActshallbetreatedtobeinitiatedonserviceofnoticeoftheinquiryunder section7Atotheemployerorhisrepresentativeorattheofficeoftheemployer. 24.Aninquiryundersection7AoftheActhasbeeninitiatedagainstthe employerfortheperiodfromApril,2011toMarch,2014.Cansuchan employermakeadeclarationundertheCampaign? AdeclarationcanbemadeundertheCampaignfortheperiodforwhichnoinquiry undersection7Ahasbeeninitiated.Therefore,theemployercanmakeadeclaration foremployeeswhosedateofjoining(thedateonwhichtheemployeewasentitled andrequiredtobecomemembersofthefund)iseitherbetween01.04.2009and 31.03.2011orbetween01.04.2014and31.12.2016.Forinstance,iftheemployer declares one employee, Mr. ‘A’ to have joined on 01.04.2010,theemployerwillget thebenefits under the Campaign viz. (i) waiver of employee’s share, (ii) damages at therateofRupeeoneperyearand(iii)noadministrativecharges,inrespectofMr. ‘A’ onlyfortheperiodforwhichtheinquiryhasnotbeeninitiated,i.e.for01.04.2010 to 31.03.2011 and for 01.04.2014 to 31.12.2016. http://epf-india.co.in/
