Information On This Topic • Social media is the NUMBER ONE reason for internet and freedom of speech court cases. • Hate crimes are often committed on the internet. • Example: If some one were to post something insulting about another person through a tweet or a Facebook status, it is considered a hate crime. • Everyone has digital rights!!! Digital rights being, freedom of expression or speech and protection of privacy. • Every networking site has a policy. In order for you to use the website, you must agree to the policy or rules of the site.

  3. Information continued… If you are caught not following the rules and applying the policy on the website, you will be kicked off. As of right now social media networking websites do not have a policy that prevents bullying.

  4. PROPOSED LAW My/Our Proposed Law Concerning internet and free speech. I/We propose that a law be made which says: “Anything that is posted on a public site, must be read and approved by a board in which will give the okay to officially post it.”

Individual rights and the common good Individual rights Common good freedom of speech is protected in more ways than one with this law. not invading your personal privacy you still have private messaging. freedom of press is still yours because you are still aloud to post your thoughts and ideas on the web. prevents bulling and violence rates. keeps more court dates open in the supreme court for people's cases that need to be handled to that degree. protects everyone from breaking the citizen censorship law.

Kowalski vs. Berkeley county schools Kara Kowalski, a senior at Berkeley county high school began a conversation on my-space about a girl in her school whom of which she made negative comments about. This all went on in her home but the school took action in the issue that went on because they felt that even if the foul speech was not in school it was still wrong. Court ruling: The suspension of “charm queen” and cheerleading squad was left to stand as it was determined by the school in the first place. Precedent set:Allschool administrators must be able to prevent and punish harassment and or bulling even If it is on the internet.

  7. Kowalski vs. Berkeley county schools Cont. How it relates: If the board saw that Kara Kowalski was going to make a MySpace page that disrupted the internet, they would have stopped it.

  8. Layshock vs. Hermitage Justin Layshock and created a fake MySpace profile that was about Mr.Troch his high school principal that disclosed derogatory statements and the Troch’s took the Layshocks to court. Court ruling: The court favored the view that school officials have authority over off-campus speech is more limited than on campus speech. Precedent Set: No person was to violate the citizen censorship law from then on.

  9. Layshock vs. Hermitage Cont. How it relates: The Board could have stopped Layshock from making a fake profile and posting inappropriate things on it.

  10. Supreme Court Declines Cases on Student Internet Speech The supreme court appealed 2 cases decided on in June 2011. one case saying that their principal could not punish them for making abrupt comments on the internet because it was off campus. The other being about a false my space profile that was posting inappropriate things that the principal took action of. How it relates: These court cases wouldn't have been brought up to the supreme court if they were not as serious as the court below thought they were.

  11. Supreme Court Denies Review of Student Social Media Speech Cases Cyber bullying is one of the most popular examples of internet and free speech. The Supreme Court denied a review of a case that included cyber bullying all of the cases included the schools taking action and punishing the students involved in the case. How it relates: The board reviews everything that is posted online and that can prevent cyberbullying.
