Quality Orientation for OST Working Parties • Advance Notice of Proposed Amendment (JAR 11.065): • The Ops Div Dir may decide to initiate an A-NPA process (usually for a new concept) to “test the water” • A-NPAs will:- • Contain an Explanatory Note including justification for using the advanced NPA process • Contain preliminary new text • Be circulated for at least one month JAR-11 Amendment 1 2nd Feb 2005 Sue Bidmead CJAA OST Co-ordinator

  41. Quality Orientation for OST Working Parties • Explanatory Note (ACJ 11.065(b)(2)): • Regulatory background:- • Major points clearly highlighted, notably contentious issues. If consensus has not been achieved, the rationale behind the majority and minority positions should be clearly explained. The reasons for adopting the majority position should be described. Quality Orientation for OST Working Parties • Regulatory Impact Assessment (ACJ 11.065(b)(3.1)): • An integrated decision support process to improve the quality of the proposal • A tool to ensure that proposals are well-substantiated, by clarifying the positive and negative impacts • Used as part of an open, transparent and accountable decision making process • Should improve the effectiveness and proportionality of regulatory decisions, while minimising adverse effects JAR-11 Amendment 1 2nd Feb 2005 Sue Bidmead CJAA OST Co-ordinator

Give a clear and brief statement of the objectives:- Prioritise if multiple objectives and identify any conflicts or trade-offs. If a safety enhancement is the objective, then a safety assessment should be performed including identification of hazards and a classification of risk, taking into account probability of occurrence and severity of effects v.   50. Quality Orientation for OST Working Parties b. Options (ACJ 11.065(b)(3.2.2)): i. and iii. Identify and evaluate options:- The option of do nothing acts as base case against which other options should be compared ii. Identify equity and fairness issues:- Equity balances the negative impacts of regulation against the positive impacts. The option which is thought likely to have the largest positive impacts, may impose unfair negative impacts on a specific group or business. Relatively low impacts may be significant if borne by a small number of people or organisations.
