ECONOMIC CLIMATE • Population 1.932.917 inhabitants • GDP per capita 16.300 EURO (71% of EU) • Annual growth of GDP in 2002 2,9 % • Inflation in 2001 8,1 % • Inflation in 2002 7,6 % • Inflation in 2003 5,9 % • Export to EU of total export 63 % • Import from EU of total import 68 % Source: Eurostat and Commission

  4. Industry sectors Labour intensive industry - problem • textile, leather, wood processing and paper still employs 25 % of workforce. Electrical products industry - generally o.k. • large ones are well positioned in EU, • a few new good innovative companies, • some SME still have to catch up. EU membership will stimulate competitiveness, innovation of new products and knowledge economy

  5. PECA - May 1, 2003 • Government authority responsible for internal market and for implementation of PECA is Ministry of the Economy • SECTORS: • LVD • EMC • machinery • gas appliances • Agreement with EEA EFTA States

PECA - specifics • NO ORIGIN CLAUSE: applicable for all products originated in EU and Slovenia or any third country irrespectively of the origin of the product • all provisions in the directives are to be considered as "… authorised representative established in Slovenia or in the Community ". Excellent for trade

  7. PECA implications: INTERNAL MARKET • Technical documentation for LVD must be kept in Slovenia or on Community territory (Annex IV) • EC declaration of conformity that accompany products (machinery, ATEX, recreational craft, lifts and high-speed rail system) must be in the official language of the country of use – in Slovenian language. (BG5.4)

PECA implications : INTERNAL MARKET • translation should be provided by the manufacturer, his authorised representative established in Slovenian or within the Community, the distributor or under certain circumstances by the importer or person responsible for placing on the market. • copy of the declaration in the original language (in one of the official languages of the Community) should be supplied

IMPLEMENTATION OF LVD • Decree on electrical equipment designed for the use within certain voltage limits - Ur.l.RS, št. 53/00 (identical to 73/23/EEC) • Notified bodies: • TCL - Testing and Certification Laboratory ID 1303 • SIQ – Slov. Inst. of Quality and Metrology ID 1304 • Competent authority: Ministry of the Economy • Market surveillance: Market inspectorate of the Republic of Slovenia

  12. Principle of proportionality • old system: 100 % - pre-market surveillance • banned several hundred products per year • 0,5 % checked now - post-market surveillance • banned 2 to 5 products per year • about 30.000- 40.000 electrical products Statistics show that safety has not decreased

TEST STATISTICS Electrical products 2001: 184 products • 47 % non-compliant • 34 % dangerous (27) • 1 lethal 2000: 317 products • 46 % non-compliant • 26% dangerous (29) • 5% lethal (6) Similar for 2003 VERY GOOD HIT RATE !!! All cases - to minor offence judge Lethal cases: recal, notification in mass media

  16. TRAPEX - 2002 2002: • 19 notifications checked (not found in Slovenia) • additional 16 checked in December 2002 (Christmas lighting chains) • 3 notifications send to TRAPEX ICSMS and RAPEX in the future
