HISTORY • Almond Tree Delayed MSBU • Subdivision platted with 72 parcels - February 29, 1988 • Pond tracts dedicated to Orange County by Plat • County maintained MSBU established May 1988 for 3 pond tracts (A, B, and C) • A Delayed MSBU established at HOA request in December 31, 1990 • No assessments collected by Orange County for maintenance since 1990
HISTORY • Almond Tree Delayed MSBU- Two Agreements • MSBU Resolution executed • Maintenance Requirements Agreement- No record of ever being executed

Delayed MSBU Pond Issues • Delayed MSBU Ponds • Routine mowing is being performed, however, other maintenance activities are not always guaranteed • Pond sediment and structural repairs do not occur thereby affecting the functionality • Due to Zero Assessment, no reserves are collected for major repairs and/ or rehabilitation by the County

STAFF RECOMMENDATIONS • Public Hearing to convert to a traditional County MSBU- November 14, 2006- Hearing continued • Public Works Staff met with HOA -January 3, 2007 • Reached an equitable settlement
Share rehabilitation cost of $35,000 50/50 split - $17,500 each • Establish County Maintained MSBU for retention ponds for future maintenance • Issue Right of Way Utilization Permit and Use Agreement at no cost to the HOA for additional aesthetic maintenance cycles beyond what the County provides STAFF RECOMMENDATIONS

ACTION REQUESTED • Approval to convert Almond Tree Delayed MSBU Ponds to County maintained ponds. • Rehabilitation costs to bring ponds to County standards shared 50/ 50 percent with parcel owners • Approval for 3 year assessment of $17,500 to the 72 parcel owners to bring ponds up to standard • Approval to assess annual MSBU at established maintenance rates • Issue Use Agreement and Right-of-Way Utilization permit to HOA at no cost for additional aesthetic maintenance cycles beyond what the County provides
