OVERVIEW • Orange County participates in the National Flood Insurance Program (NFIP) • Allows residents to purchase flood insurance in flood prone areas
OVERVIEW When FEMA issues new maps and study a community must: • Adopt new maps and study • Amend existing ordinance to comply with minimum NFIP requirements
OVERVIEW Current Floodplain Management Ordinance approved in 1982 FEMA regulation changes Participation in the NFIP requires adoption and enforcement of minimum floodplain management standards FEMA Model ordinance used to update countyordinance

ORDINANCE REVISIONS Floodplain Ordinance has three articles with twenty eight sections Nine sections of the ordinance have changes incorporating the model language The remaining nineteen sections have mainly grammatical and text clarifications
ORDINANCE REVISIONS Article I New definitions added and existing definitions revised Examples include critical facilities, existing construction, freeboard, flood proofing Adopts new maps dated Sept. 25, 2009 Violations section updated
ORDINANCE REVISIONS Article II New text clarifying floodplain administrator’s responsibilities Appoints Public Works Director (or designee) Grants/denies floodplain permits Variance procedures New text authorizes appeals to be heard by Development Review Committee
ORDINANCE REVISIONS Article II Appeals to Development Review Committee New text explaining appeals process Appeal must be made within 30 days of permit denial Public hearing within 30 days of receiving appeal request Variance may be granted with conditions
ORDINANCE REVISIONS Article III General Standards New text specifying the need for subdivision proposals to minimize flood damage Applicant to provide state & federal permits Compensating Storage to be provided in same basin Specific Standards New manufactured homes must provide proper anchoring to resist flotation or lateral movement Critical facilities (e.g. Hospitals, Jails) to be located above the 500 year floodplain
ORDINANCE REVISIONS Additional Amendments Replace the phrase “erection, addition or substantial alteration improvement of any building or structure or portion thereof,” with “commencement of any development” on page 9, at lines 338-341. Delete references to Sections 320.8359 and 161.053, F.S., on page 19, at lines 807-808. Insert the phrase “at the sole cost of the applicant.” at the end of sentence on page 22, at line 968. Strikethrough “Regulation” on page 27, at line 1169. Replace the phrase “determine whether” with “assure that” on page 38, at line 1699.

BOARD ACTION Approve and Adopt the Ordinance amending Chapter 19, Floodplain Management, Article I through Article III. Grant staff permission to correct scrivener’s/non-substantial typographical errors.
