Performance-based Reimbursement Rate Increases for New Meal Patterns Section 201 Memo: Pending USDA guidance Implementation: Within 18 months of Proposed Rule, but no earlier than October 1, 2012 Provides an additional 6¢ per lunch for schools that are certified to be in compliance with final meal pattern regulation.
Nutrition Requirements for Fluid Milk Section 202 Memo: SP 29-2011 April 14, 2011 Implemented: School Year 2011-12 Removes requirement that schools serve milk in a variety of fat contents and instead requires that schools offer a variety of plain or flavored fluid milkconsistent with the Dietary Guidelines’ recommendations.
Nutrition Requirements for Fluid Milk Section 202 • Must offer at least two choices • fat-free (skim) or low-fat (1%) varieties • Pasteurized milk that meets State and local standards must be served. • Flavored (skim only) or unflavored milk can be served to meet the variety requirements • Whole milk and reduced fat (2%) cannot be served.
WaterSection 203 Memo: SP 28-2011 April 12, 2011 Implementation: schools to comply with this requirement as soon as possible, but not later than the beginning of School Year 2011-12 Schools must make potable wateravailable to children at no charge in the place where meals are served during the meal service.

Nutrition Standards for All Foods Sold in SchoolsSection 208 Memo: Implementation: Proposed rule within one year of enactment. Requires USDA to establish national nutrition standards for all food sold and served in schoolsat any time during the school day. Allows exemptions for school sponsored fundraisers if the fundraisers are approved by the school and are infrequent.

Categorical Eligibility of Foster ChildrenSection 102 Memo: SP 17-2011 Revised 3/16/2011 Implementation: October 1, 2010 Expands categorical eligibility for free meals to a foster child who is the responsibility of the State or placed by a court.
Independent Review of ApplicationsSection 304 Memo: Implementation: Winter 2012 Establishes annual reporting requirements for each local educational agency required to conduct second level review of applications. State agencies must also annually report results to USDA.
Privacy Protection Section 301 Memo: SP 19-2011 February 15, 2011 Implementation: Effective October 1, 2010 but no later than July 1, 2011 Removes requirement that the adult household member who signs the household application must also provide his/her complete Social Security Number (SSN)as a condition of eligibility. Now, they need only supply the last four digits of their SSN or indicate they do not have a SSN.
