Legislations • SALA (Act 70/70), CARA (Act 43/83), PDA (Act 6/08) • All applications for subdivision or change of land use • Recommendations made to DAFF (national mandate) • Province has concurrent function with DAFF • Legislative mandate rests with Agriculture as custodians of the agricultural resources of SA • Agricultural land is a scarce, irreplaceable and non-renewable resource
All land excluding land: • Town planning scheme of a town or city • Land which is agricultural holding (Transvaal) registration Act 22 of 1919 • Which is township as defined in section 102(1) of the deeds registration act 57 of 1937 • State land • Land excluded from provision of act 70 • SALA remains valid and enforceable • SALA is administered by DAFF • Province can only advise (sub2b of S4) and enforce (sub3 of S4)
DARD’s role with regard to act 70 • Participate in and contribute towards SDF and IDP policy process • Ensure systematic implementation of the act at provincial level • Establish and implement monitoring and evaluation systems • Promote communication and information dissemination • Take an active part in ensuring that principles enshrined in the Policy are incorporated in the SDF’s and IDP’s of local authorities
Cooperate with other Government entities in all matters pertaining to land use planning. • Give comments for the processing of applications for sub-division of agricultural land and changes in the land use.
Challenges • Inadequate consultation between Provincial and National office • Parallel process in submission of application (application submission process) • Separate or parallel registration and administration process by province and national office • Applications Database management • Lack of capacity (vacancies and skills)
