Title Five of the Student Body StatutesThe Student Judicial System • Powers of the Supreme Court • The Supreme Court shall have the ability to summon any registered student to appear before the court, otherwise known as a subpoena. • The Supreme Court shall be an appellate court for cases tried in other bodies at FSU that recognize the Supreme Court’s appellate jurisdiction. • The Supreme Court can by majority vote remove an elected or appointed official from office after receiving the articles of impeachment from the Senate. • Review of Constitutional Amendments • All proposed Constitutional Amendments or Referenda shall be reviewed by the Supreme Court to make sure they are in line with Federal and State Laws, and the FSU Constitution and Statutes. • All decisions by the Court shall be given no later than 21 days after initial submission. If the Supreme Court fails to meet this deadline, the Senate is entitled to vote on the measure. • Advisory opinions are non binding, but are merely a professional opinion of the court. If a Constitutional amendment or referenda is amended after initial review, it must be submitted a second time to the Supreme Court. • All records of the court must be kept in archive and made available to the public when requested.
Title Five of the Student Body StatutesThe Student Judicial System • The Office of the University Defender • The University Defense Team shall be made up of two Law Students of second year standing who are appointed by the Chief Justice of the Supreme Court and approved by the Senate. • The University Defense Team shall assist students upon request who are on trial in the Supreme Court. The University Defenders may also represent impeached officials of the Student Government who are the defendant in such cases. • The University Defense Team may not represent individuals involved in civil litigation before the Supreme Court, as the Office of General Counsel shall handle these duties. • The Office of General Counsel • The General Counsel shall represent parties requesting assistance in the drafting and execution of all motions before the court. They shall also provide representation during litigation before the court. • All members of the court except for the Chief Justice may request to take leaves of absences for the summer. Temporary Justices may be appointed in their place.
