Pilot Program for Regulation of Mooring • Legislative Direction: • The FWC, in consultation with the DEP, is directed to • establish a pilot program to explore potential options for regulating the anchoring or mooring of non-live-aboard vessels outside the boundaries of public mooring fields. • Five counties or municipalities shall be selected for • participation in the pilot program, prior to July 1, 2011. • The pilot program shall expire on July 1, 2014 along with all ordinances enacted under this statute. 327.4105 F.A.C.

Pilot Program for Regulation of Mooring • Goals: • Develop and test policies and regulatory regimes that - • Promote establishment and use of public mooring fields. • Promote public access to the waters of this state. • Enhance navigational safety. • Protect maritime infrastructure. • Protect the marine environment. • Deter improperly stored, abandoned, or derelict vessels. 327.4105 F.A.C.

  4. Pilot Program for Regulation of Mooring • Charges to the Commission: • Select all locations & participants prior to July 1, 2011. • Provide consultation and technical assistance. • Coordinate review of any proposed ordinance. • Monitor and evaluate each location at least annually, make modifications as necessary to meet program goals. • Report findings and recommendations to the Governor, the President of the Senate, and the Speaker of the House of Representatives by January 1, 2014. 327.4105 F.A.C.

Pilot Program for Regulation of Mooring • Locations & Participants: • County or municipal government. • Must be associated with a properly permitted mooring field. • Must be geographically diverse and consider the various users and means of using the waters of this state. • Two off the east coast, two off the west coat and one within Monroe County. • Shall be selected by the Commission prior to July 1, 2011. 327.4105 F.A.C.

Pilot Program for Regulation of Mooring • Pilot Ordinances: • Shall be consistent with the goals of the pilot program. • Shall only apply to vessels outside authorized mooring fields. • Shall be reviewed by DEP, USCG, FIND or WCIND, and organizations representing vessel owners or operators. • Shall take effect and become enforceable only after approval by the commission. • Shall expire with the pilot program on July 1, 2014 and shall be inoperable and unenforceable thereafter. 327.4105 F.A.C.
