Rules regarding competition(Law of Georgia on Civil Service, articles 29- 36) • Current situation • The Law of Georgia on Civil Service determines the rules of competition announcement/conduction in detail; this is also stated in the Decree of the President. • Outcome • According to the amendments, the law shall determine only basic rules regarding competition. • The rules of conducting competition will be determined in detail by the Decree of the President. • According to the Decree of the President, an institution shall be obliged to inform candidates in writing about the decision concerning their candidacy no later than one month after the competition ends, whether successful or not.
Announcement of vacancies by legal entities of public law via www.hr.gov.ge (Article 111 is added to the Law of Georgia on Civil Service) • Current situation • According to the current legislation, legal entities of public law do not announce vacancies via www.hr.gov.ge. • Outcome • Under the current changes, the Legal entities of Public Law are obliged to announce any vacancies on www.hr.gov.ge (except religious, educational and cultural legal entities of public law). • These changes make recruitment procedures more transparent.
Competition announcement by the self-government organisations
Abolishment of the Selection and Certification Commissions(Law of Georgia on Civil Service, articles 33 -36)
. Main requirements for civil servants (Law of Georgia on Civil Service, article 15) • Current • situation • According to the current legislation any capable citizen of Georgia, who has relevant knowledge and experience and has reached the age of 21, can be appointed as a civil servant. • Outcome • Due to the amendments, the minimum age for civil servants has been decreased from 21, to 18 (equalised with the self-government servants age).
Today, job descriptions are described only for vacant positions for the purpose of competition announcement. Job descriptions (Article 711 is added to the Law of Georgia on Civil Service) • Current situation • The job descriptions will imply clarity in the working process by defining key areas of employee’s rights and responsibilities, as well as defining reporting, supervision and appraisal procedures. • These changes are based on the recommendations of international organisations and local NGOs (SIGMA,OSGF). • Outcome
Appointment of temporarily acting civil servants • Current legislation allows the appointment of temporarily acting civil servants without competition for an indefinite period of time. (Paragraph 2 is added to the article 30 of the Law of Georgia on Civil Service) • Current • situation • According to the amendment, the appointment of a temporarily acting civil servant will be permitted once. The deadlines for holding acting positions have also been defined -1 year for acting high officials and 2 months for all other civil servants. • This amendment ensures the need for conducting competitions for appointment in the civil service. Probation period (Article 24, paragraph 4 of the Law of Georgia on Civil Service will be abolished)
Removal of mandatory certification and introduction of a new appraisal system (Law of Georgia on Civil Service , Chapter VIII )
Promotion(Article 77 of the Law of Georgia on Civil Service will be abolished)
Strengthening the role of the Civil Service Bureau of Georgia( Article 130, Paragraph 2, Sub paragraph s “d1” will be added)
Abolishment of civil servants’ obligation to submit declarations (Article 18, paragraphs 1-3 of the Law of Georgia on Civil Service willbe abolished and amendments will be carried out in article 2 , paragraph1)
After the abolishment of the civil servants obligation to submit declarations the following officials will submit asset declarations to the Civil Service Bureau in addition: • City Local governing body members (Tbilisi, Batumi, Rustavi, Poti, Kutaisi) • Local governing and executive body, and their deputies • District and city district heads of local executive bodies
