Compensatory Educational Services • Additional services beyond those normally due to a student that are intended to remedy a district's failure to provide FAPE • Purpose is to put students in the position they would occupy without the denial of FAPE • Should be individualized • Offers should be made in writing, with specific terms of frequency and duration
When must the District make-up missed sessions? • If a session is missed due to provider absence, including long-term absences • If the session is missed due to schedule changes related to state assessment, end of course exams, or optional flexible school year, IF NEVER APPROVED BY AN ARD COMMITTEE
If the District will be without a service provider due to long-term absences or shortages • Assess the potential impact on students and identify a prioritized case load ASAP: • Distribute available services to high need and high profile cases; • Consider service delivery options that will allow for skill maintenance.
If the District will be without a service provider due to long-term absences or shortages • Discuss the potential impact with other administrators, including Superintendents and Human Resources Directors • Potential liability for denial of FAPE • Opportunities to partner with other Districts or other service providers • Consultation with counsel concerning some students
If the District will be without a service provider due to long-term absences or shortages • Notify parents of effected students in writing • Identify that there may be a service disruption • Confirm that the District is taking steps to minimize the disruption and to remedy shortages • Confirm that the District will provide compensatory services to students who do not receive service in accordance with IEPs • Confirm timeline for updating the parents on situation • Offer an ARD committee meeting
If the District will be without a service provider due to long-term absences or shortages Make and document efforts to locate additional personnel or alternative service providers.
If the District will be without a service provider due to long-term absences or shortages • As soon as the shortage or absence is resolved • Contact parents in writing to offer specific compensatory services (in terms of hours or minutes) and to schedule an ARD committee meeting to discuss compensatory services: • based on the actual number of missed sessions; or • based on changes in performance identified by assessment (more appropriate for longer shortages).
If the District will be without a service provider due to long-term absences or shortages • If disruption lasts longer than a grading period: • Send correspondence to parents updating them concerning status of efforts; • Offer ARD committee meetings to all effected, convene ARD committee meetings for high priority cases; • Consult counsel to discuss ‘systemic dismissals’ (if that has crossed someone’s mind ) or reimbursement for private services
