WA Opt-In Legislation Major Elements • CA standards • Adopts beginning 2009 model year (2008 CY); • Can’t sell/register new 2009+ non-CA vehicles in WA • ECY to write rules by 12/31/2005 • Emission Testing (I/M) • Exempts CA vehicles from testing (2009 MY+) • Allows private businesses to do I/M testing, 2012 • Sunsets total I/M program, July 1, 2020 • Diesel Retrofits • Allowed for any public diesels, not only school buses • Budget adds $2 million new money to the $5 million for school buses

WA Opt-In Legislation Summary of Ecology/Environmental Case • Most effective way to address largest source of greenhouse emissions • Less smog, less air toxics, better health • Same speed, acceleration, towing, hauling, safety as current vehicles • Fair to have largest source do its share • Enables future economic and transportation growth without further control on business • $3,400 lifetime fuel savings offsets $1,000 cost • At 2.38 per gal.

WA Opt-In Legislation Issues • Manufacturers • Expensive, • No benefits, identical to Fed standards • I’ll do it “My Way”, don’t force the CA path • Dealers • Limits choice of larger vehicles • ZEV “quota” = too many cars, not enough trucks/SUVs • Hard to trade with other dealers to get desired styles • Will send buyers out of state

Sales • Not able to get large pick-ups for work • Limited availability of large pick-ups for 5th wheels, campers and boat towing • Repair Shops • Longer warranties reduces their business

  8. WA Opt-In Legislation Disposition • Problematic amendments in Senate • Program made dependent on OR opt-in • Program became a “no ZEV” opt-in • Governor Gregoire considering veto of both of these provisions
