Introduction • Scottish Governments focus on prevention and early intervention • Target of 2012 • Strengthen local partnerships • Enable local authorities to monitor trends in private rented sector
Key Points For Landlords • Duty to inform the local authority only at point of raising proceedings for possession through court – NOT NTQ • There is specific information the landlord must give the local authority on a specified form either by post or electronically.
Information to be given to the LA • Name, address and contact details of LL • Name & address of LL’s legal rep • LL registration Number • Name & full postal address of tenant • Start date of tenancy • Date of raising proceedings • Court in which proceedings have been raised • The enactment under which proceedings have been raised.
Failure to Comply • No direct sanctions • It will be linked to the Fit and Proper person test of Landlord Registration • Accredited landlords may lose accredited status
