  1. PROFESSIONAL COMPETENCY

  2. InTurkey, where 94 % of alldomesticfreightandpassenger transport is carriedoutbyroad, a longaspired Law on RoadTransportationwasissued on July 2003. Beforethe Law on RoadTransportationNr. 4925 beingenacted, therewas no specificlegislationtoregulateroadtransportationactivities.

  3. Duetotheharmonisation of suchregulations in thefield of roadtransportationwiththe EU acqui, regulationsrelatedto market accessionandaccesiontotheprofessionwereenacted in linewiththerelevant EU norms. TheEU’sdirectivesthatstipulateconditionsforacesstotheprofessionandtothe market weresubstantiallyreflected in thelegislatoryworkandthe 3 maincriteriaforeseen in suchdirectivesconcerningfinancialstanding, professionalcompetencyandgoodrepute as necesssaryqualificationsfordriversandmanagerswhoaimtowork in transport business in EU memberstaes, wereincorporated in the Turkish legislation

Twoamongsuchcriteria, namelytheprofessionalgoodreputeandfinancialstandingwereregulatedundertheRegulation on RoadTransportationprepared on thebasis of the Law Nr. 4925, a separateregulationconcerningthecriteriaforprofessionalcompetencywasissued on 03 September 2004 and legal conditionswerelaiddown in thisregulationwithregardtoprofessionalcompetency as requiredforaccessiontotheprofessionandfortheperformance of theprofession.

Underthe Law on RoadTransportationissued in 2003, freightandpassengertransportationwereaimedto be regulated in accordancewith EU standardsand in thisdirection, requirementsconcerning Professional CompetencyCertificateforCommercialVehicleOperationsuch as training, examinations, etc. werebroughtundertheresponsibility of theMinistry of Transport. Suchrequirementsareregulatedunderthe “Regulation on Professional CompetencyforRoadTransportationOperations” enteredintoforce in 2004.

Inthisregard, ourMinistryprioritisedtheissueandtohave it servetheobjectivesandaims as well as with a viewtoensureeveryprofession has basicandsufficientknowledge on transport, launchedprofessionalcompetencytrainingcoursesthatwereonlyimplemented in some of the EU memberstates at that time, undertheRegulation on Professional CompetencyTrainingforRoadTransportationOperations.

Thereasonbehindtheenactment of thislegislation: Definesprofessionalcompetencytrainingandexamination, thequalifications of trainingorganisationsthat can be accreditedforsuchtrainingandrelevantcertifications, professionalcompetencycertificatesto be grantedtothosewhocompletesuchtrainingortothosethatareexemptfromsuchrequirement as well as relevanttermsandconditionsconcerningprofessionalcompetency as requiredfortheperformance of roadtransportationoperations in Turkey.

  8. Thetypes of Professional CompetencyCertificatesto be grantedtodriversandmanagerswhoareengaged in roadtransportationandaresubjecttotherequirementforobtaining Professional CompetencyCertificateare as follows:

Types of professionalcompetencycertificatesaredefined in threemaincategories; -Seniormanager (ÜDY), -Middlelevelmanager (ODY), -Driver (SRC) Seniormanager (ÜDY): Chairman of Board of Directors, member of board of directors, general manager, general coordinator, secretary general orotherpersonsemployed at otherpositionswhorepresent a realor legal person and/oradministerall of thesecontinuouslyandeffectively as pertheregulation on Road Transport, Middlelevelmanager (ODY): Director/Administrator, chief, expert, operationalmanager, operatororpersonsemployed at otherpositionswhorepresentandadministercontinuouslyandeffectivelythe transport –relatedactivities of a realor legal person or an independentunitwithinitsframework as pertheregulation on Road Transport, Driver (SRC): Person whoadministers a motor vehicle on road

GRADES FOR PROFESSIONAL COMPETENCY CERTIFICATES Correlationsbetween Professional CompetencyCertificates as pertheirgradesare as follows; Persons holding ÜDY1 typecertificatesareconsidered as holding ÜDY2,ODY1 and ODY2 typecertificates, Persons holding ÜDY2 typecertificatesareconsidered as holding ODY2 typecertificates, Persons holding ÜDY3 typecertificatesareconsidered as holding ÜDY4, ODY3 and ODY4 typecertificates Persons holding ÜDY4 typecertificatesareconsidered as holding ODY4 typecertificates, Persons holding ODY1 typecertificatesareconsidered as holding, ODY2 typecertificates, Persons holding ODY3 typecertificatesareconsidered as holding ODY4 typecertificates, Persons holding SRC1 typecertificatesareconsidered as holding SRC2 typecertificates Persons holding SRC3 typecertificatesareconsidered as holding SRC4 typecertificates

  13. Bearing in mindthecurrentconjuncture of thesector, thelegislationallowscertainexemptions.

ExemptionfromProfesionalCompetencyTrainingRequirement Providedthattheypasstherelevantexamination • Graduatesfromtransportation, logistics, transport economy, roadtrafficdepartments at universities/vocationalhighschoolswith 4 yeargraduatedegreeeducationandthosepersonsthatholdgraduatedegrees in otherfields but obtainedmaster, post-graduateordoctoratedegrees in theabovefields, • Personswhowereemployed at theDirectoratefor Land Transportationor at RegionalDirectorates of theMinistry of Transport as head of department , deputyregionaldirectors as well as thosewhowereemployed at theheadquartersorregionalbranches of theNationalDirectorateforSecurity as head of departmentorsecuritydirector at traffic-relateddepartmentsfor at least 3 years, • Personswho can provebydocumentsthattheyhavebeenengaged in theprofessionfor at least 5 yearswith ODY type Professional CompetencyCertificates, UDY type Professional CompetencyCertificatesaregrantedtopersonswhoareexemptfromprofessionalcompetencytrainingandpasstherelatedexamination,

Exemptionfrom Professional CompetencyTrainingRequirement • VocationalHighSchoolgraduates, providedthattheypasstheprofessionalcompetencyexams, areexemptfromtherequirementtoattendprofessionalcompetencytrainingandtheyaregranted ODY type Professional CompetencyCertificate in accordancewiththeexamtheypass.

  16. Exemptionfrom Professional CompetencyTrainingandExaminationRequirement • Relevant ODY certificate is grantedtograduatesfromtransportation, logistics, transport economy, roadtrafficdepartments at universities/vocationalhighschoolswith 4 yeargraduatedegreeeducationandthosepersons t holdgraduatedegrees in otherfields but obtainedmaster, post-graduateordoctoratedegrees in theabovefields, • Personswhowereemployed at theDirectorratefor Land Transportationor at RegionalDirectorates of theMinnistry of Transport as head of department, regionaldirectoror a higherpositionfor at least 3 yearsandchiefinspectorsand legal advisors of theMinistry of Transport aregranted ÜDY certificatetheyrequest, • Personswhowereemployed at theDirectoratefor Land Transportationor at RegionalDirectorates of theMinistry of Transport as head of department , deputyregionaldirectors as well as thosewhowereemployed at theheadquartersorregionalbranches of theDirectorate of Security as head of departmentorsecuritydirector at traffic-relateddepartmentsfor at least 3 yearsaregranted ODY certificatestheyrequest, • SRC typecertificatesaregrantedtograduates of departmentsofferingdrivereducation at HigherEducationOrganisation.

  17. UndertheRegulation on Professional CompetencyTrainingforRoad Transport Operations, professionalcompetencyqualification is requiredforallactors in thesector, whiletakingintoaccount of thecurrentconjuncture of thesector, theacquiredrights of thoseexperienced in thesectorbeingrespectedandallowing a process of transition, theyaregrantedonceandforallexemptionfromtrainingandexaminationrequirementandtherighttoobtainProfesionalCompetencyCertificatedirectly.

  18. As of 25/2/2006, UDY typeprofessionalcompetencycertificate is grantedtohighlevelmanagerswhohavebeenfor at leastfiveyearsemployed at organisationsoperatingaccordingtotheregulation on Road Transport, providedthattheyprovetheirstatus, As of 25/2/2006, ODY or SRC typeprofessionalcompetencycertificatesaregrantedtopersonswith at leastthreeyears of professionalexperience, providedthattheyprovetheirstatus.

  19. Inordertoensuretherequests of citizensthatwishtobenefitfromthisrightandtoenforcethelegislation in a timelymanner, ourMinistryfound it necessarytoreceiveoutsourcedsupport, theissuewasevaluatedlegallywithregardtosuchneedand it wasconsideredappropriatetoreceivesuchsupoortfrompublicorganisationsand/oruniversities.

  20. With a viewtowork in a coordinatedmannerandwithregardtotheexpertise, wecontacted Gazi Universitywhich is theonlyuniversity in Turkeywithgraduatedegreeprogramme on “Transport andTrafficEngineering” and a protocolwassigned on 23.12.2005 followingnegotiations. Theprotocolwasimprovedtakingintoaccounttheneedsdemonstratedduringtheimplementation of thelegislationand it wasamended on 01.07.2010.

  21. The “Gazi University – Ministry of Transport Road Transport PracticeandResearch Center” established at Gazi Universityforthepurpose of reviewingtheapplications of personsthatwantto be exemptedfromthetrainingandexaminationrequirementandtoobtainProfesionalCompetencyCertificatesdirectly; otherworkincludingtheissuance, publication, distributionanddelivery of certificates, renewal of lostcertificates.

  22. So far, applicationsfrom a total of -1.777.930 drivers, - 38.909 managers engaged in thesector, wereevaluated. out of which, -1.446.201 drivers, -17.524 managers weredelivered Professional CompetencyCertificates as exemptfromthetrainingandexamnationrequirement , depending on theiracquiredrights.   23. GAZI UNIVERSITY ROAD TRANSPORT PRACTICE AND RESEARCH CENTER AS PER THE EXEMPTION, OUT OF1.816.839 PERSONS 1.463.725 PERSONS RECEIVED. February2011

  24. Conditionsconcerningtrainingorganisationsto be authorisedtooffer Professional CompetencyTrainingwerealsoregulatedunderthesameregulationandorganisationsthat can offersuchtrainingwereallowedtoopentrainingcenters on thebasis of theirauthorizations. As of today, 197 trainingcentersareaccreditedandabout 115.499 peoplereceivedtraining in suchcenters.

  25. PROFESSIONAL COMPETENCY REQUIREMENT NUMBER OF TRAINING CENTERS ACCREDITED BY MINISTRY OF TRANSPORT –197 • EXAMS WERE CONDUCTED • FOR MANAGERS AND DRIVERS • ATTENDING TRAINING COURSES 89.414 PERSONS ADMITTED TO EXAMS. 62.830PERSONS SUCCEEDED SUCCESS RATIO =% 70,26

  26. Thetrainingcurriculumto be followedduringprofessionalcompetencytrainingswaspreparedalsotakingintoaccount of the EU acqui. In general terms, thepurpose of theprofessionalcompetencytraining is toensurenecessarylevel of knowledgeandskillsfortheperformance of theprofession. Inthisregard, a curriculumwith minimum informationthat is expectedfromdriversandmanagersengaged in roadtransportation in linewiththe EU acquiand a requirementwasintroducedforalldriversandmanagers in thesectortohavesuchknowledge. Thecoursesforeseento be included in thecurriculumtoensureprofessionalcompetencytrainingachievesitsobjectiveswilltransformcertainimproperlyadoptedbehavioursandattitudesconcerningtrafficcultureandsafetyinto modern behavioursandattitudesandtheyaresoughtto be organisedwithregardtotrainingcriteriaandthecurrentqualifications of participants.

  27. StudieswithrespecttotheRegulation as well as therequestsreceivedfromtrainingcentersthatseekauthorisationdemonstratedtheneedfornewregulationsconcerningtrainingcoursesandexaminations. - It is extremelydifficulttofindtrainers in thefield of professionalcompetencywhich is a newpractice in Turkey. Forthis, with a viewtomaketrainingcourseswidespreadaroundTurkey, coupledwiththedemandsfromthesectorfortraining of thetrainersandthepractices in Europe, thetraining of trainers is considered as a priority. Especiallybearing in mindtheneedforcertification of trainersto be employed at trainingcentersaccordingtotheirspecialisations, henceensuring a uniformityamongthetrainers, studieswithintheframework of Gazi University’sRoad Transport PracticeandResearch Center havebeenunderway.

  28. Questionshavebeenobtainedfromthetrainingcenters in orderto set up test banksfortheexamsto be conductedbyourministry. Attention is paidtoensuresuch test bankscontainquestionsthatenablesoundassessment of thelevel of knowledge of participantsboth in terms of thecurriculum as well as thetechnique of testing. Beforeeveryexamination, questionsarerequestedfromeachtrainingcenter. Theavailability, accuracy, etc. of suchquestionsareevaluatedandotherstudies in which Gazi University is alsoinvolvedandwhichconcernsthe test bank projectarestillunderway.

  29. So far,a total of 14 Professional CompetencyCertificateExamshavebeenconductedforsectorprofessionalswhoobtained Professional CompetencytrainingGraduate (Completion) CertificateuponcompletingtrainingcoursesorganisedbyTrainingOrganisationsaccreditedbyourMinistry. In total 89.414 personsappliedfortheexams. Around 15.000 participantsareexpectedtoattendtheexamplannedfor 19 March 2011.
