Valid Forms of ID • A motor vehicle driver’s license issued by any state, territory of the United States, the District of Columbia, the Commonwealth of Puerto Rico or by an official government agency of Canada or Mexico; • A permanent resident card issued by the United States citizenship and immigration services (green card); • An identification card issued to a member of the armed forces; • An internationally accepted passport document with discernable date of birth and photograph • An identification card issued by the Wyoming Department of Transportation; or • An identification card issued by the Eastern Shoshone or Northern Arapahoe Tribes of Wyoming. • Proof that a licensee or his employee or agent demanded, was shown and acted in reasonable reliance upon the information contained in any one (1) of the above documents as identification is a defense to any criminal prosecution or action for the suspension or revocation of a license.   15. UNDERAGE FREQUENTING • Keep underage persons out to the maximum extent possible • Allowing underage patrons invites attempted consumption • Allowing underage patrons invites conflict between servers and family and friends of the underage person MAPP Program

  16. UNDERAGE FREQUENTING • W.S.12-8-301(a) No person who has legally provided alcoholic liquor or malt beverage to any other person is liable for damages caused by the intoxication of the other person. • Key term: LEGALLY • Serving someone who is underage is NOT LEGAL. MAPP Program

UNDERAGE FREQUENTING • W.S.12-8-301(d) For purposes of this section “licensee” is as defined in W.S.12-1-101(a)(viii) and includes the licensee’s employee or employees. • If anyone employed by the licensee provides alcoholic liquor or malt beverage to an underage person and that underage person causes damage or death the licensee is responsible under the law. • W.S.12-8-301(a) No longer applies.   18. VISIBLE INTOXICATION • Observe your patrons • Back servers but don’t rely on them to use their best judgment in all cases • Know the signs of intoxication • Poor coordination • Slurred speech • Poor judgment MAPP Program

  19. VISIBLE INTOXICATION • Statute was not unconstitutional. W.S.12-8-301 did not infringe upon the fundamental right of access to the courts established by the Wyoming constitution or upon any other fundamental interest, including equal protection of the law, by creating a cause of action against persons who illegally sold or served alcohol to people who caused injuries, while not recognizing the same cause of action against persons who legally sold or served alcohol. Greenwalt v. Ram Rest. Corp. • Wyoming Supreme Court decision (Wyo. 2003). 3 to 2 MAPP Program

  20. ALTERNATIVE TRANSPORTATION • Provide or arrange for alternative transportation for intoxicated patrons to the maximum extent possible • Attempt to keep intoxicated patrons from driving away • Watch patrons and staff to prevent over service and intoxication in the first place MAPP Program

  21. FOOD SERVICE • Serve food if possible to slow down alcohol absorption • Offer high-protein or fatty foods such as meats and cheeses which slow absorption of alcohol • Avoid salty, crunchy items because they cause patrons to drink more MAPP Program

  22. SERVING PRACTICES • DO NOT STACK DRINKS • Use symbols such as tokens, receipts or shot glasses to indicate purchases • Track number of drinks, especially in a relatively short period of time • Attempt to serve a group or table at a time not a patron at a time MAPP Program
