Statutory Authority & Regulation • Statutory Authority • The 1998 amendments to the Commercial Space Launch Act, added authority for establishing procedures to issue “safety approvals” for use in conducting licensed commercial space launch or reentry activities. • Regulation • Under Part 414 Safety Approval Final Rule, Effective September 14, 2006, the FAA may issue a safety approval for the following elements: • (a) launch vehicle, reentry vehicle, safety system, process, service, or any identified component thereof; or • (b) qualified and trained personnel, performing a process or function related to licensed launch activities
Background • A safety approval is entirely voluntary • The FAA does not require a safety approval for launch or reentry licensing or permitting activities • A safety approval allows an operator to use an approved item without re-examining the element in a license or experimental permit application • Safety Approvals may be issued separate from a licensing or permitting determination
What Is A Safety Approval? • The safety approval indicates that the FAA considers the use of the approved item, to be consistent with FAA launch and reentry licensing or permitting • Safety Approval usage must be consistent with launch or reentry safety and fall within the operating limits of the approval • A safety-approved item may be offered to a prospective launch or reentry licensee or permittee
What A Safety Approval Is Not • Certification by the FAA • An indication of mission success or failure • A finding of suitability for purposes outside the stated limitations of the safety approval • An authorization to conduct a launch or reentry, or to operate a launch or reentry site • A guarantee that a safety-approved element of a launch or reentry proposal will function in accordance with supplier specifications
Who Is Eligible For A Safety Approval? • Manufacturer of a launch of reentry vehicle or component • Designer /developer of a safety system or process • Persons who perform safety critical functions in conducting a licensed or permitted launch or reentry
What Is Eligible For A Safety Approval? • Launch or reentry vehicle and personnel who perform safety functions • Certain safety systems, services and processes integral to launch or reentry operations NOTE: • FAA’s determination of eligibility is based upon acceptance of identified standards • Safety approvals will not be issued for items that do not perform a safety function in the conduct of a licensed or permitted launch or reentry
Criteria For Obtaining A Safety Approval • Establishing Standards • The FAA will rely on the following sources of standards when evaluating safety approvals: • FAA or other Federal regulations • Government-developed or adopted standards • Industry consensus standards • Applicant proposed safety standards • Any proposed safety standard must be publicly available or be made publicly available to be acceptable
Criteria For Obtaining A Safety Approval • Performance and Verification Requirements • Demonstrate satisfaction of a standard • Conduct verification and submit results • Scope of the Safety Approval • The scope of the safety approval will be limited by the scope of the demonstration contained in the application • Terms and Conditions • The FAA will determine specific terms and conditions of a safety approval individually
Additional Information • Safety Approvals are valid for 5 years • Safety Approvals can be transferred • Safety Approvals can be renewed or modified • A holder of a safety approval must maintain all records • A holder of a safety approval may request confidentiality for their data
Conclusion • Development of a safety approval application is facilitated through early and frequent consultation between the applicant and the FAA to assure public safety issues are identified and adequately addressed
