6. PHANTOM RIDERS MOTORCYCLE SAFETY RIDE RELEASE OF LIABILITY, EXPRESS ASSUMPTION OF RISK, AND HOLD HARMLESS AGREEMENT 1. I hereby acknowledge and agree that participation in the Phantom Riders Motorcycle Safety Ride may have inherent risks, even when the greatest care is taken. I also hereby acknowledge and agree that I have full knowledge of, understand, and appreciate the nature and extent of all such risks, including the risks of cuts, abrasions, broken bones, minor or severe bodily injury, death, or property damage resulting from participation in the program. I further acknowledge and agree that the above list does not include all possible risks associated with participation in the program, and that the above list in no way limits the extent or reach of this RELEASE OF LIABILITY, EXPRESS ASSUMPTION OF RISK, and HOLD HARMLESS AGREEMENT. 2. I hereby certify that I have conducted my own personal safety inspection, that I have met all required State and Federal laws/regulations to ride my motorcycle, and that my motorcycle is fit for the purpose of riding in the Phantom Riders Motorcycle Safety Ride. I understand that the safety inspection conducted by Phantom Riders Motorcycle Safety Ride personnel is not a substitute for my own personal inspection. I HEREBY CERTIFY THAT I AM VOLUNTARILY ASSUMING ALL THE RISKS ASSOCIATED WITH MY PARTICIPATION IN THE PHANTOM RIDERS MOTORCYCLE SAFETY RIDE. I UNDERSTAND THAT I WILL BE SOLELY RESPONSIBLE FOR ANY LOSS, INJURY, OR DAMAGE (INCLUDING DEATH) WHICH I MAY SUSTAIN. I FURTHER UNDERSTAND THAT, BY THIS AGREEMENT, I AM WAIVING ANY RIGHT TO ASSERT ANY AND ALL CLAIMS, DEMANDS, AND POSSIBLE CAUSES OF ACTION OF ANY NATURE WHATSOEVER THAT MAY OTHERWISE ACCRUE FROM ANY LOSS, DAMAGE, OR INJURY (INCLUDING DEATH) TO MY PERSON OR PROPERTY, IN ANY WAY RESULTING FROM, OR ARISING IN CONNECTION WITH, OR RELATED TO, THE PHANTOM RIDERS MOTORCYCLE SAFETY RIDE, AGAINST FORT HOOD, TEXAS, THE UNITED STATES ARMY, THE UNITED STATES GOVERNMENT, AND/OR THEIR OFFICERS, AGENTS, OR EMPLOYEES, FOR SUCH LOSS, INJURY, DAMAGE, OR DEATH, FROM ANY CAUSE WHATSOEVER, EVEN IF CAUSED BY THEIR ORDINARY NEGLIGENCE OR THE NEGLIGENCE OF OTHER PERSONS. INCLUDING WITHOUT LIMITATION THE FAILURE OF ANYONE TO ENFORCE RULES AND REGULATIONS OR TO MAKE INSPECTIONS. 3. In consideration of my participation in the Phantom Riders Motorcycle Safety Ride and/or use of facilities or equipment, I, THE UNDERSIGNED, ON BEHALF OF MY HEIRS, REPRESENTATIVES, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, DO HEREBY RELEASE FORT HOOD, TEXAS, THE U.S. ARMY, AND THE U.S. GOVERNMENT, AND THEIR OFFICERS, AGENTS, AND EMPLOYEES FROM, AND AGREE TO WAIVE MY RIGHTS TO ASSERT, ANY AND ALL CAUSES OF ACTION, CLAIMS, OR DEMANDS OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO A CLAIM OF NEGLIGENCE, WHICH I MAY NOW HAVE OR MAY HAVE IN THE FUTURE FOR ANY PERSONAL INJURY TO ME, OR FOR MY DEATH, OR FOR ANY DAMAGE TO MY PROPERTY, OR FOR ANY ACCIDENT OF ANY KIND, however caused, arising out of or in any way connected to my participation in the Phantom Riders Motorcycle Safety Ride, use of facilities and/or equipment, whether or not provided by the U.S. Army or U.S. Government, and whether or not that use is supervised or unsupervised, even if such personal injury, death, property damage, or accident is caused by the ordinary negligence of the U.S. Army, U. S. Government, and/or its officers, agents, or employees. 4. As further consideration of my participation in the Phantom Riders Motorcycle Safety Ride, and use of facilities and/or equipment, I, the undersigned, agree that I will participate in the program and use of facilities and/or equipment in accordance with its established rules, safety policies and procedures. I FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS THE U.S. ARMY, THE U.S. GOVERNMENT, AND ITS OFFICERS, AGENTS, AND EMPLOYEES, FROM ANY AND ALL CAUSES OF ACTION, CLAIMS, DEMANDS, LOSSES, OR COSTS OF ANY NATURE WHATSOEVER ARISING OUT OF OR IN ANY WAY CONNECTED TO MY NEGLIGENCE WHILE USING OR PARTICIPATING IN THE MOTORCYCLE RALLY AND USE OF THE FACILITIES AND/OR EQUIPMENT, WHETHER ASSERTED BY THE U.S. ARMY, THE U.S. GOVERNMENT, ITS OFFICERS, AGENTS, OR EMPLOYEES, OR BY ANY THIRD PARTIES WHO MAY BE INJURED ON ACCOUNT OF OR IN ANY WAY RESULTING FROM MY PARTICIPATION IN THIS RALLY AND USE OF THE FACILITIES AND/OR EQUIPMENT. 5. I certify that I am of lawful age (18 years or older) and otherwise legally competent to sign this release of liability and hold harmless agreement. I further certify that I understand that the terms of this document are legally binding, that I agree to these terms, and that I am signing this document, after having carefully read it, of my own free will. OVERALL FT HOOD STADIUM LAYOUT & ENTER/DEPARTURE ROUTE Motorcycle inspections will conducted by unit prior to arrival 1 Week to conduct motorcycle inspections (3-6 Nov) No motorcycles permitted to ride w/o inspection being completed Motorcycles will arrive as a unit (1CD, 3ACR, etc…) Arriving motorcycles will be lined up on Railway Dr Riders will be lined up towards the East, 4 bikes in a row All bikes will be full of fuel prior arrival. There will be no fuel stops. Patriot Guard & Combat Veterans Motorcycle Assoc will form up at the Stadium Parking Lot. Patriot Guard will lead formation & CVMA will bring up rear of formation Depart stadium (Railway Dr, Wratten Dr, Darnell Lp to Santa Fe exit) Return (TX 190, Santa Fe entrance, Darnell Lp, Wratten Dr to Railway Dr)
