  4. The following discussion on Temporary Flight Restrictions (TFR) is intended to be general in nature. The Cape Canaveral TFR description and associated rules are based on historic TFR’s, and may not accurately describe future TFR’s. Pilots are advised to obtain current NOTAM’s.

  5. Following the events of September 11, 2001, Temporary Flight Restrictions are in place in many states. As outlined in a Letter to Airmen issued July 11, 2002, TFR’s are not depicted on aeronautical charts. A number of TFR’s are continuously active but many are activated only during special events. Current TFR information is available through the Flight Service Stations or DUATS.

There are several FAR Part 91 References to TFR’s • FAR PART 91.137 • - Temporary flight restrictions in the vicinity of disaster/hazard areas. • FAR PART 91.138 • - Temporary flight restrictions in national disaster areas in the State of • Hawaii. • FAR PART 91.141 • - Flight restrictions in the proximity of the Presidential and other parties. • FAR PART 91.143 • - Flight limitations in the proximity of space flight operations. - This is the over water area east of the Kennedy Space Center that is depicted on the charts (see following slide).

FAR PART 91.144 • - Temporary restriction on flight operations during abnormally high barometric pressure conditions. • FAR PART 91.145 • - Management of aircraft operations in the vicinity of aerial demonstrations and major sporting events. • FDC NOTAM 2/0199 • - Prohibits all aircraft operations within a 3 nautical mile radius/3000 feet AGL and below over any stadium having a seating capacity of 30,000 or more in which a Major League Baseball, National Football League, NCAA Division One Football, or Major Motor Speedway event is occurring unless under ATC control for arrival/departure procedures at an airport adjacent to the stadium.

  8. What do these Part 91 references and NOTAM 2/0199 have to do with the Cape Canaveral Temporary Flight Restrictions published in conjunction with the Space Shuttle Launches? Nothing, although the NOTAM has more to do with it than any other reference.

  9. The Regulation behind the Cape Canaveral TFR is 14 Code of Federal Regulation Part 99 – Security Control of Air Traffic

  10. 14 Code of Federal Regulation Part 99 -- Security Control of Air Traffic • 99.3 Definitions. • - Defense Area means any airspace of the contiguous United States that is not an ADIZ in which the control of aircraft is required for reasons of national security. • Part 99.49 Defense Area • - All airspace of the United States is designated as Defense Area except that airspace already designated as Air Defense Identification Zone.

NORAD ORGANIZATION • NORAD Commander in Chief (CINC) - Appointed and responsible to the President of the United States and the Prime Minister of Canada. - Headquarters at Peterson Air Force Base, Colorado. - Maintains a command and control center at Cheyenne Mountain Air Station. • THREE NORAD REGIONS - Alaskan NORAD Region (ANR) – Headquarters at Elmendorf AFB, Alaska. - Canadian NORAD Region (CANR) – Headquarters at Canadian Forces Base, Winnipeg, Manitoba. - Continental United States NORAD Region (CONR) – Headquarters at Tyndall AFB, Florida. • Tasked with defending contiguous United States (CONUS).

Three Continental United States NORAD Region (CONR) air defense sectors. - Western Air Defense Sector (WADS) - Northeast Air Defense Sector (NEADS) - Southeast Air Defense Sector (SEADS) – Headquarters at Tyndall AFB, Florida • Tasked with defending the Space Shuttle. Prior to September 11, 2002, CONR assets postured outward.

  14. Where does the Cape Canaveral TFR come from? • NASA makes a request to the Air Force. • SEADS decides what airspace is needed, and submits a request to the FAA. • FAA Southern Region in Atlanta reviews request. • Affected air traffic facilities give input. • Request forwarded to FAA Headquarters in Washington D.C. where request is approved or denied. • Using the NOTAM system as authorized by 14 CFR 91.139, the FAA issues a NOTAM describing the temporary flight restrictions for this area.

What are the pilot’s responsibilities under Part 99? • 99.7 Special security instructions. • - Each person operating an aircraft in an ADIZ orDefenseArea shall, in addition to the applicable rules of this part, comply with special security instructions issued by the Administrator in the interest of national security and that are consistent with appropriate agreements between the FAA and the Department of Defense. These special security instructions are contained in the TFR NOTAM. To obtain your special security instructions, pilots must READ THE NOTAM !

EFFECTIVE 0301160640 UTC (JANURARY 16 AT 0140 LOCAL) UNTIL 0301162240 UTC (JANURARY 16 AT 1740 LOCAL). • Flight Planning is crucial. • Launch dates/times change. • Route deviations may have to begin prior to effective time. • Several pilot deviations have resulted from failure to plan properly. • Last minute PIC. • N.C. to South FL then back.

FOR REASONS OF NATIONAL SECURITY PURSUANT TO 14 CFR SECTION 99.7, SPECIAL SECURITY INSTRUCTIONS, FLIGHT RESTRICTIONS ARE IN EFFECT WITHIN A 40 NM RADIUS OF 283700N/0803700W (MELBOURNE/MLB/VOR/DME 004 DEGREE RADIAL AT 30 NM) FROM THE SURFACE UP TO BUT NOT INCLUDING FL180 (EXCLUDING THAT AIRSPACE OUTSIDE THE U.S. 12 NAUTICAL MILE LIMIT), AS FOLLOWS: • The TFR consists of two concentric rings. • A 30-NM and a 40-NM ring centered on the above lat/longs. • Airspace within the 30-NM ring most restrictive. Special security instructions are contained in Part A of the NOTAM.

PART 91, PART 125, AND VFR FLIGHT OPERATIONS ARE PROHIBITED WITHIN A 30 NAUTICAL MILE RADIUS OF 283700N/0803700W (MELBOURNE/MLB/VOR/DME 004 DEGREE RADIAL AT 30 NAUTICAL MILES) • Along the coast, includes airports from Massey Ranch (X50) south to but not including Melbourne. 30-NM ring extends west to within 4 miles of Sanford and Orlando Executive Airports. • Also includes privately owned airports. • Key word is PROHIBITED. • Special security instructions for the airspace contained within the airspace between the 30 and 40 NM rings are in Part B of the NOTAM.

FLIGHT OPERATIONS WITHIN THE AIRSPACE BETWEEN THE 30 NM AND 40 NM RADIUS OF 283700N/0803700W (MELBOURNE/MLB/VOR/DME 004 DEGREE RADIAL AT 30 NAUTICAL MILES) ARE PERMITTED ONLY IN ACCORDANCE WITH THE FOLLOWING PROCEDURES: 1) THE PILOT SHALL OBTAIN A DISCRETE TRANSPONDER CODE AND CLEARANCE FROM THE APPROPRIATE ATC FACILITY PRIOR TO ENTERING THE AIRSPACE. • Key words: SHALL and PRIOR. • Towered Airports. • Non-towered Airports. 2) THE PILOT SHALL MAINTAIN CONTINUOUS RADIO COMMUNICATIONS WITH ATC AND DISPLAY THE ASSIGNED TRANSPONDER CODE AT ALL TIMES WHILE WITHIN THE TFR AIRSPACE. • Approach controls will hand off to adjacent facilities or vector aircraft clear of TFR airspace before terminating radar. • Compliance is a real safety issue. • PD resulted from not understanding this part of NOTAM.

  21. (3) PART 91 AND VFR OVERFLIGHT TRAFFIC SHALL MAINTAIN AN INDICATED AIRSPEED OF 180 KNOTS OR LESS. C. EXCEPTIONS: MILITARY AIRCRAFT AND AIRCRAFT ASSOCIATED WITH CAPE CANAVERAL OPERATIONS ARE EXEMPT FROM THIS TFR. RESCUE/RECOVERY, MEDICAL/LIFEGUARD, EMERGENCY EVACUATION, LAW ENFORCEMENT, DEPARTMENT OF STATE, AND FIRE FIGHTING OPERAIONS ARE PERMITTED ONLY WITH PRIOR APPROVAL FROM THE APPROPRIATE ATC FACILITY.

  30. Special Procedures for Orlando Executive and Sanford Airports. Orlando Executive (ORL) and Orlando Sanford (SFB) Airports are located in the airspace between the 30-n.m. and 40-n.m. rings. Pilots are required to obtain a discreet transponder code and clearance from ATC prior to entering the TFR. Pilots are required to maintain continuous radio communications with ATC and display the assigned transponder code at all times while within the TFR airspace. No practice approaches are authorized during ORL Runway 25 and SFB Runway 27 operations. Arriving aircraft may expect delays. Special Procedures for Airports in Daytona Beach Area Daytona Beach (DAB) is located outside of the TFR. New Smyrna Beach and Spruce Creek airports are between the 30 and 40-NM rings. Can you fly IFR? VFR?

Over Flight Traffic Expect Reroutes • AIRCRAFT DEPARTING DAYTONA BEACH ATCT AIRSPACE - Expect reroutes in the vicinity of WORMS Intersection then west of Orlando International. - Aircraft landing airports southeast of Orlando and south of Melbourne, may not receive on course until in the vicinity of R2901. • AIRCRAFT DEPARTING AIRSPACE NORTH OF DAYTONA BEACH - Expect reroutes around Orlando International ATCT’s airspace.

AIRCRAFT DEPARTING SOUTH FLORIDA AIRPORTS, FROM PALM BEACH AND NORTH. - Aircraft landing Daytona Beach Airspace expect routes over BAIRN Intersection, then radar vectors SCOTE Intersection, direct KIZER Intersection direct Ormond Beach. - Aircraft landing north of Daytona Beach Airspace, expect routes over BAIRN Intersection then Ocala.

( ) SUBJECT: TEMPORARY FLIGHT RESTRICTIONS CANCELLATION:  July 11, 2004 TEMPORARY FLIGHT RESTRICTIONS (TFR) ARE IN PLACE IN MANY STATES. THESE TFR’s ARE NOT SHOWN ON SECTIONAL OR OTHER AERONAUTICAL CHARTS. TFR INFORMATION IS AVAILABLE THROUGH THE FLIGHT SERVICE STATIONS (FSS) OR DUATS. VIOLATING A TFR AREA CAN LEAD TO INTERCEPTION BY MILITARY AIRCRAFT AND POSSIBLE FAA LEGAL ENFORCEMENT ACTION BEING TAKEN. PROPER FLIGHT PLANNING IS CRUCIAL TO AVOIDING FLIGHT INTO TFRs. PILOTS MUST FAMILIARIZE THEMSELVES WITH ALL NOTAMS AND TFR’s ALONG THEIR PROPOSED ROUTE.  EVERY PILOT NEEDS TO OBTAIN THE LATEST NOTAMs FROM AN FSS CONTROLLER OR VIA DUATS IMMEDIATELY PRIOR TO FLIGHT. THE FAA HAS PLACED SPECIAL EMPHASIS ON THE NEED FOR FSS TO PROVIDE THIS INFORMATION TO PILOTS. PILOTS SHOULD QUERY THE FSS CONTROLLER TO ENSURE THAT THEY HAVE THE MOST CURRENT TFR INFORMATION FOR THEIR FLIGHT. IF IN DOUBT ASK THE FSS CONTROLLER IF THERE ARE ANY TFRs TO AVOID ON YOUR ROUTE OF FLIGHT. BECAUSE CHANGES IN AIRSPACE OPERATIONS ARE CONSTANT IT CANNOT BE STRESSED ENOUGH HOW ESSENTIAL FLIGHT PLANNING IS TO PILOTS AND THAT IT IS CRITICAL THEY OBTAIN ALL NOTAMS PERTINENT TO THEIR ROUTE OF FLIGHT INCLUDING ALL TFRS.               /S/
