  2. WHAT IS CITIZENSHIP? In legal terms, the citizenship is the condition of the person to whom the legal system of a state recognizes the fullness of the civil and political rights.

  3. Citizens: relationship between citizen and state. • Foreigners :who have another citizenship, which is different from that of the country where they live. • Stateless: people without citizenship.

HOW TO GET THE CITIZENSHIP • By virtue of IUS SANGUINIS, birth by a parent in possession of citizenship. • by virtue of IUS soli (law of the land) to be born in the territory of a marriage with a citizen • in some jurisdictions, citizenship may be acquired by the wife of a citizen, but not by the husband. • by naturalizationof those people who live in a country for a certain number of years.

  5. IUS SANGUINIS Conception "objective". Based on: • Blood • Ethnic group • Language

  6. IUS SOLI Conception "subjective". You buy the nationality of the country where you were born.

  7. In ancient Greece to possess the nationality meant for the individual, to participate in legislative functions and judicial poleis. The city, then, had the right to participate in the political life of their community. This right was granted on the basis of the birth and the bonds of blood only to free citizens and adults of the community. The citizenship was instead denied to slaves and to women.   9. In the case of conubium (legitimate marriage): • foreign+ citizen = roman son • Town + Foreign= stranger son • In the case of illegitimate union : • Foreign+ citizen =alien son • Foreign +town= roman son

  10. An example of immigration is that of Mounir Barian. He was born in Morocco. In 1999 he came to Italy for a Judo Championship. His visa expired after a month from the competition and so he decided to remain in Italy. Brian stayed here as a stowaway and just in 2002 he was able to obtain his documents and not work illegally. In 2009 he married an Italian woman and a year later they had a son. The son obtain the Italian citizenship automatically after his birth.

A reform of the law of citizenship that stipulates that even children born in Italy from foreign parents can be Italian citizens and a new rule that allows the electoral law to administrative workers regularly has been presented in Italy for five years. To achieve these goals the two bills had to collect 50.000 signatures by the end of February 2012. • 110.000 signatures were delivered to the Chamber.

  12. FRANCE Children born in France by foreign parents have the right to French citizenship, the children of legal immigrants can become French: • at 13 years for request of their parents • at 16 years for their same request • At 18 years automatically.

  13. GERMANY The children of foreigners born in Germany automatically acquire the citizenship if their parents have lived in the country for 8 years.

  14. United States of America • Having a relative with American citizenship • By marrying an American citizen • after 5 years of work the Green Card is issued. After 5 years from the possession of the Green Card you can apply for the citizenship which is released after having passed a test about the language, the history and the American Constitution.

POLAND and ITALY • IUS SANGUINIS:to be born from a parent in the possession of the citizenship • IUS SOLI: born by stateless parents • ON DEMAND: if born in Italy and have resided continuously until maturity. • FOR NATURALIZATION: after ten years of legal residence in Italy with absence of criminal record. • ON REQUEST: to be born in territories already belonging to the dissolved Austro-Hungarian Empire.
