Charlotte NPDES Facts • First NPDES permit in 1993 • Third permit renewal being finalized • Expect a 2009 deadline for Post construction controls (NC Phase II is ‘07) • Over half local streams are impaired • Bacteria, turbidity/sediment, biological • NC State Minimum: • Control & treat runoff from first 1-inch • 30’ stream buffer on intermittent downstream

  3. Stakeholder Involvement Multi-Objective Process • Local government partnership • Mecklenburg and Charlotte, and Towns • 36 meetings held over 18 months • Multiple objectives considered • Consensus reached • Elected official decisions ongoing

Stakeholder Process Goals • Achieve compliance with the Phase I and Phase II minimum requirements • Address the concerns of NCWRC and USFWS for the Yadkin Basin • Federally endangered mussel • Affects permitting for water sewer line expansion • Slows/halts development and annexation • Address the causes of impairment 303d & TMDL (key for redevelopment) • Address detention measures for the control of storm water volumes and peaks (flooding)

Stakeholder Goal #3 – Recommendations to Address 303d • Phase II minimums and NEW development • Ordinance applies to redevelopment • Other City priorities • Areas of compromise • Detention & fee-in-lieu for these redeveloping areas • Balances competing objectives • Impairment reversal through redevelopment

City BMP Maintenance and Preparation of Local BMP Manual • Construction & maintenance is very important • BMP’s built now often have problems • Stakeholders/Staff agreed HOA’s are unlikely to be successful • Recommended City funded maintenance of SF BMP’s • Fee funded – expect 10-15% budgetary impact

City BMP Maintenance and Preparation of Local BMP Manual • Charlotte monitors 20 structural BMP’s • Monitoring results used to develop local BMP manual • Sizing driven by local monitoring data • Long term operation, inspection, maintenance in mind • Minimize long term costs, maximize success • Prescriptive and gives examples • Equal or better protection than NCDENR manual • More info on Char-Meck website

  9. Next Steps • Outlying Towns adopt ordinance July ’07 • Charlotte still looking at costs of stakeholder version of ordinance • City Council to hear details of stakeholder process this summer • Possible adoption by Early 2008
