Riot Damages Act What is a riot? - Public Order Act 1986: “12 or more persons present together, using or threatening unlawful violence for a common purpose and their conduct (taken together) is such that it would cause a person of reasonable firmness present at the scene to fear for his personal safety” • Is this a riot? • Is BI covered • Alternative trading costs? • Loss of profit / revenue? • 14 days to submit the claim – extended to 42 days • Time limits don’t work for BI • Agree claims for recovery before test case on BI?
