  3. Statutory Requirements • New White House Memorandum, Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement • Signed February 21, 2012 • Federal Acquisition Regulation • New Final Rule

Executive Order 13514 • E.O. 13514 requires that 95% of all new contracts, including contract modifications, for products and services specify: • Biobased products • Energy-efficient products • Water-efficient products • Environmentally preferable products and services • Recycled content products • Non-ozone depleting substances • Non or less toxic or hazardous alternatives

White House Memorandum • Ensures that Executive agencies and departments effectively execute Federal procurement requirements for biobased products. • Requires measuring of the annual number of procurements: • that include direct purchases of biobased products • the number of construction and service contracts that include the purchase of biobased products • the annual volume and type of biobased products the Federal government purchases.

  6. New FAR Final Rule • Implement additional reporting requirements. • Requires Contractors to report the biobased products purchased under service and construction contracts • Requires Contractors to report annually the product types and dollar value of any biobased products purchased during the preceding fiscal year.

  7. Contract Writing System • Revised USDA’s automated Contract Writing System (Integrated Acquisition System (IAS) • Added biobased elements to the IAS • Now can gather data on all contracts to track procurement of biobased products • Actual data results presented

FedBizOpps for Reporting • Review all USDA janitorial, maintenance and repair, and construction contracts in FedBizOpps to ensure appropriate language and clauses. • Follow-up with all Points of Contact where BioPreferred® is not incorporated. • Provide education and tools to Points of Contact. • Actual data results presented.

  9. Procurement Forecast • Added BioPreferred® icon/data field to the USDA procurement forecast for all projected contracts • Data field is Yes or No • Helps industry focus on which contracts contain BioPreferred® • Helps USDA to gather and analyze data • Actual data results presented

Federal Procurement Data System – Next Generation (FPDS-NG) • In 2010 and 2011, USDA worked with OMB, DoD, GSA and other agencies to add data elements on BioPreferred® to FPDS-NG • Now, it is an actuality • Further refinement of the BioPreferred® data elements • Generation of Reports for agencies and government-wide

New Reporting and Compliance Measures • New White House Memo includes biobased purchasing in the Office of Management and Budget’s Scorecard. • Memo requires Federal agencies to include goals and milestones for biobased purchasing in the Strategic Sustainability Performance Plans. • Memo requires new public reporting of Federal agencies’ biobased product purchasing.

  12. New Reporting and Compliance Measures • Memo requires Federal agencies to sample and verify that biobased products are being included in purchasing contracts. • Memo requires USDA in consultation with Chief Acquisition Officers Council to develop an reporting template to facilitate the annual reporting requirement. • Update, update on all of above
