What is DIN Din means Director Identification Number • How to apply for DIN The concept of a Director Identification Number (DIN) has been introduced for the first time with the insertion of Sections 266A to 266G of Companies (Amendment) Act,2006. As such, all the existing and intending Directors have to obtain DIN within the prescribed time-frame as notified.
Step I:- Obtain Provisional DIN The applicant is required to fill-up and submit formDIN-1 online for obtaining provisional DIN. Form DIN-1 is available under 'Apply for DIN' tab on the left hand side panel under DIN' link on the homepage of MCA portal. • First we go to www.mca.gov.in for apply DIN Number. • Then you want a Login ID on MCA 21.
How create login ID in MCA 21 Portal. First we go for New user on MCA 21.
This is a new user registration form. Fill this form as a registered user and fill all * are mandatory.
After create your login Id open it .There is so many option are present in this portal see below
Go to Home page and select services then Director Identification Number (DIN).
After selecting director identification Number u see this type page then u select Apply for DIN.
After click Apply for DIN u see form DIN-1 Application of Allotment of Director Identification Number Fill * mandatory field then after system generate Provisional DIN.
After Generation of Provisional DIN you have to go for login Id and pay Miscellaneous fees
After paying Miscellaneous fees. The applicant is required to take a print-out of Form DIN-1(containing provisional DIN generated online). Fill the service Request Number (SRN) of the fee paid. Sign the DIN application form manually and paste a good resolution photograph in the space earmarked. Attach the photocopies of the 'Proof ofIdentity' (Attach additional proof, if 'Father's name and 'Date of Birth' is not indicated in the 'Proof of Identity') and the 'Proof of Residence' with DIN application form and tick the relevant checkbox against the document name. Get the photograph and the attached supporting documents attested from an approved authority as specified in form DIN-1. The certifying authority must mention its particulars such as Name, COP No. etc, and affix its seal/ stamp. Complete set of documents is required to be sent to MCA DIN Cell atNoida, by post, courier or hand delivery, as per convenience, within 60 days from the date of generation ofprovisional DIN online.
Processing of DIN applicationDIN application is received by MCA DIN Cell. DIN application form and attached supporting documents are scrutinized and if found in order, the provisionalDIN is approved and activated in the system. If there is any defect in the DIN application, the provisionalDIN is rejected. It takes about a week's time tocomplete this process. DIN approval/ rejection letter is generated and sent by post to the applicant. The status of application can also be tracked from the 'DIN Approval status' tab in the DIN corner.
What is DIN2 or DIN3?DIN2-Intimation of DIN by the Directors to the Company; DIN3-Intimation of DIN by Company to ROC. • Post-approval changes in particulars of DIN-1If there is any change in the particulars submitted in form DIN-1, File form DIN-4 for intimating the changes in the particulars within 30 days. For instance in the event of change of address of a director, he/ she is required to intimate this change by submitting Form DIN-4 along with the required attested documents with MCA DIN Cell.
The Companies (Amendment) Act, 2006 • Theory Part Insertion of new sections 266A, 266B, 266C, 266D, 266E, 266F and 266G After section 266 of the principal Act, the following sections shall be inserted, namely:— "Director Identification Number
266A Application for allotment of Director Identification Number Every— • Individual, intending to be appointed as director of a company; or (b) Director of a company appointed before the commencement of the Companies (Amendment) Act, 2006, shall make an application for allotment of Director Identification Number to the Central Government in such form, and manner (including electronic form) along with such fee, as may be prescribed: Provided that every director, appointed before the commencement of the Companies (Amendment) Act, 2006 shall make, within sixty days of the commencement of the said Act, such application to the Central Government: · No. 23 of 2006. Assented to by the President of India on 29.05 .2006. Published in the Gazette of India, Extraordinary, Part II, Section I, Dated 30.05.2006. Provided further that every applicant, who has made an application under this section for allotment of a Director Identification Number, may be appointed as a director in a company, or, hold office as director in a company till such time such applicant has been allotted the Director Identification Number.
266B Allotment of Director Identification Number The Central Government shall, within one month from the receipt of the application under section 266A, allot a Director Identification Number to an applicant, in such manner as may be prescribed. • 266C Prohibition to obtain more than one Director Identification Number No individual, who had already been allotted a Director Identification Number under section 266B, shall apply, obtain or possess another Director Identification Number. • 266D Obligation of Director to intimate Director Identification Number to concerned company or companies Every existing director shall, within one month of the receipt of Director Identification Number from the Central Government, intimate his Director Identification Number to the company or all companies wherein he is a director.
266E Obligation of company to inform Director Identification Number to Registrar (1) Every company shall, within one week of the receipt of intimation under section 266D, furnish the Director Identification Number of all its directors to the Registrar or any other officer or authority as may be specified by the Central Government. (2) Every intimation under sub-section (1) shall be furnished in such form and manner as may be prescribed. • 266F. Obligation to indicate Director Identification Number Every person or company, while furnishing any return, information or particulars as are required to be furnished under this Act, shall quote the Director Identification Number in such return, information or particulars in case such return, information or particulars relate to the director or contain any reference of the director. • 266G. Penalty for contravention of provisions of section 266A or section 266C or section 266D or section 266E If any individual or director, referred to in section 266A or section 266C or section 266D or a company referred to in section 266E, contravenes any of the provisions of those sections, every such individual or director or the company, as the case may be, who or which, is in default, shall be punishable with fine which may extend to five thousand rupees and where the contravention is a continuing one, with a further fine which may extend to five hundred rupees for every day after the first during which the contravention continues.
