  1. THE ROLES OF: • Courts and Tribunals There are lots of courts and tribunals in Australia that are involved in human rights issues e.g. The Anti Discrimination Board (NSW)

THE ROLES OF: • Courts and Tribunals But the MAINbody that deals with human rights in Australia is the Australian Human Rights Commission The AHRC: Monitors human rights issues in Australia Checkslaws to see if they breach our human rights commitments Has investigations into the actions of government institutions if they have denied human rights (but can only make a SUGGESTION to the government) PROMOTES human rights (through big campaigns to improve the knowledge of human rights in Australia)

CASES YOU CAN NAME FROM THE AHRC: • Brown v Immigration Department (2012) • A woman was held in immigration detention with men. • This was against the ICCPR. • The AHRCrecommended that the government apologise and give her compensation. • The government said no. • Mr SD v Australia (2012) • This was about a Chinese guy held in detention in breach of the ICCPR. Nothing was done about it. • Tuifangaloka v Australia (2012) • (This one is just so the Samoans have a case that only they can spell…) • This was about a 9 year-old girl being held in detention, breaching the ICCPR AND the CRC. Because 9 year-olds are a danger to us all. THE ROLES OF: • Courts and Tribunals

The Ombudsman • This is ONLY if there was an action taken by the decision-maker that was: • Unreasonable; • Unjust; • Oppressive; • Improperly discriminatory;or • Not properly explained • There is a Commonwealth Ombudsman, and the States also have their own ombudsmen (e.g. the NSW Ombudsman, if, say, you have been mistreated by NSW Police). • It’s where you go if you feel you’ve been reallybadlymistreated, rather than just “someone made a decision that didn’t go my way”.
