3. What is an MSBU? Special assessment for receiving specific benefit or service
Apportioned to each property based on cost of service, not property value
Cost equals contractor fees plus administrative costs
4. To Whom Would it Apply? All single-family residences, duplexes, triplexes, and quadplexes that have been issued a Certificate of Occupancy, including
Individually owned mobile home lots, and
Modular homes, RVs, or trailers that have residential permanent license tags.
Commercial Mobile Home Parks with 10 or more spaces may be able to opt out if proof of adequate service is provided.

Define the Service Area
Comply with Unfair Competition Act

12. Obtain Community Support Most difficult part of process
Must be a citizen initiative
Signed petition is the recommended method
Utilize public meetings, HOA meetings, church groups, etc.

13. Define the Service Area Establish Boundaries
Needs to be of sufficient size to provide an economy of scale

14. Comply with Unfair Competition Act Conduct a public hearing
Provide 45 days advance notice of hearing to commercial haulers

Provide 3 years notice to current haulers or pay them 15 months gross receipts

The MSBU is the entity through which the County will collect the assessments and contract the service provider

17. Other Considerations Implementation of waste collection service cannot start until compliance with the provisions of the Unfair Competition Act.
18. Other Considerations The actual amount of the assessment cannot be determined until receipt of the bids and award of the contract for collection services.
19. Other Considerations The MSBU assessment is paid in arrears.
This means that for the benefit received during any calendar, the assessment will appear on the tax bill that comes out in November of that year.
20. Other Considerations There will be an initial assessment the year before collection service begins.
This assessment pays for all expenses incurred to date, creates working capital for the district, and offsets future costs to the district.
21. Other Considerations Collection of the assessment will be by the Uniform Method of Collection along with ad valorem taxes.
Discounts are available for early payment.
The assessment constitutes a lien on the property and failure to pay the assessment can ultimately lead to the sale of the property just like ad valorem taxes.
22. Other Considerations The cost of the assessment is not just for garbage collection. It includes the benefits discussed earlier, such as reduced truck traffic and enhanced community aesthetics.
