  7. issue(A)Whether Government issues a formalcertificate as ccTLD manager to JPRS ? • If government issues formal certificate, it is very helpful to persuade ICANN that JPRS is formally a delegee in the nation. • It is sometimes difficult for government to issue certificate for a private company • Option 1 : JPNIC and JPRS communicate with government to get verbal recognition of the status of JPRS as a delegee • Option 2 : ????? but therefore

How ICANN recognizes Government’s endorsements • If trilateral agreement is signed, it is absolutely OK. • It is sometimes difficult for government to have a contract with a private company • Option 1 : JPNIC and JPRS have a bilateral contract. And Government endorses the contract by giving signature on it with optional comments. • Option 2 : JPNIC and JPRS have a bilateral contract. And Government just reports to ICANN that “Government recognizes and endorses the contract.” • Option 3 : JPNIC and JPRS have a bilateral contract. And Government does nothing in response to ICANN’s query. This may mean implicit endorsement. but therefore

Basic Principles of Management and Administration of .JP Top Level Domain Since its beginning…JPNIC has played roles for • Top priority on the interest of the Internet community in Japan • .JP serves for the community • reliable and stable name services • Good relationship with JPG • Model ccTLD Sponsorship Agreement was modified to reflect these principles

  13. ccTLD Sponsorship Agreement (.JP) • Different from the Model Sponsorship Agreement… • Respecting achievements made by the Internet community in Japan, the Agreement clarifies the roles of JPNIC and JPG in the management and administration of .JP top level domain • ICANN inquires to JPG whether it is Japanese Internet community’s consensus that JPRS would be the Sponsoring Organization for .JP top level domain = > Endorsement from JPG to ICANN (2002.1.30) • Based on the November 9 Memorandum executed by and between JPRS and JPNIC, JPNIC and JPG jointly ensure the public interest of the .JP top level domain management and administration = > Consultation process of JPNIC and JPG

Definitions 2.1 Governmental Communication => Authoritative Communication - Communication among JPRS, JPG, and JPNIC 2.11 Term of the Agreement - When Transfer from JPNIC to JPRS is completed (April 1, 2002 planned) 4. The Sponsoring Organization Obligations 4.3 JPNIC, as well as JPG, plays a role on behalf of Internet Community - Overseeing the policy and taking part in Registry Data Escrow Program 4.3 JPNIC, not JPG, signs the agreement concerning Data Escrow 6. Miscellaneous 6.2 When JPG notifies ICANN about the inappropriateness of JPRS as .JP sponsorship it needs consultation with JPNIC 6.3 When JPRS is disqualified, re-redelegee will be reassigned in coordination with JPG and JPNIC

In future • The ccTLD Sponsorship Agreement (.JP) signed by ICANN and JPRS • IANA undertakes redelegation of .JP from JPNIC to JPRS • JPNIC and JPRS complete the transfer of the management and administration of .JP TLD (by March 31 2002) • As the Sponsoring Organization, JPRS, taking into consideration of public interest of the Internet community, carries out the management and administration of .JP top level domain • On behalf of the Internet community in Japan, JPNIC, in consultation with JPG, follows the procedures in order to ensure the public interest of .JP top level domain
