Mandate • Legal Basis • 1. Republic Act No. 7279 (UDHA). • 2. Memorandum Oder No. 74, Series of 2002, directing the HUDCC to formulate and adopt guidelines and implement post-proclamation activities in areas proclaimed as socialized housing sites. • 3. Executive Order No. 131, Series of 2002, declaring open to disposition for socialized housing purposes certain government-owned lands defined under Republic Act No. 7279.
Local or Project Inter-Agency Committee • HUDCC convenes the LIAC (or PIAC) immediately after the issuance of a Proclamation. • The LIAC is usually chaired by HUDCC or the LGU. Its powers and functions include: • Formulation of implementing rules (IRR) and code of policies (COP) for beneficiary selection. • Creation of working sub-committees on social preparations, beneficiary selection, arbitration and award , technical land research , and others. • Approval of the masterlist of qualified beneficiaries, land valuation and pricing and lot disposition scheme. • Monitoring and evaluation of the post-proclamation process. • Resolution of issues elevated by the subcommittees.
Process under MO 74 (15 DAYS) (30 DAYS) PROCLAMATION ISSUED Convey proclamation to LGU concerned; Create/convene PIAC/LIAC MOA with LGU; Create Local Housing Board (LHB) (90 DAYS) Community Dev’t. Plan c/o Proclamation Administrator
LIAC Structure The LIAC shall be composed of but not limited to the following: HUDCC NHA PCUP DENR LGU NGOs and POs Landowner or the designated administrator
Local Inter-Agency Committee (LIAC) • POWERS AND FUNCTIONS • Formulation of policies and guidelines for the implementation of post-proclamation activities; • Creation of working sub-committees on community relations and social preparations, beneficiary selection, award and arbitration, physical development, estate management, technical land research, and such other sub-committees as it deems necessary; • Approval of the following: • Community master development plan, project implementation plan/schedule;
Local Inter-Agency Committee (LIAC) • Beneficiary selection guidelines; • Masterlist of qualified beneficiaries, disqualified families and new occupants • Lot pricing policy and schemes; • Lot disposition scheme; • Final list of beneficiaries to be awarded Certificates of Lot Award (CeLA). • Monitor and evaluate the entire post-proclamation process; • Resolve issues elevated by the sub-committees .
Roles of the Agencies HUDCC Convenes the Local Inter-Agency Committee (LIAC) which will formulates and adopts the necessary rules and policy guidelines to implement the Proclamation; Comes up with a schematic work flow plan for the speedy disposition of the land to the beneficiaries; Identifies and mobilizes fund resources for project implementation; Approves the masterlist of qualified beneficiaries, in coordination with the LGU concerned;
Roles of the Agencies • HUDCC • Coordinates the participation of concerned agencies, NGOs and POs; • Supervises and monitors the progress of the implementation of the Proclamation; and • Call on any government department or agency for assistance whenever necessary.
Roles of the Agencies • NHA • Acts as administrator of areas proclaimed as socialized housing site, when engaged by the landowner or administrator or if so stated in the proclamation; • Takes special role in the beneficiary selection process, keeping an alpha-listing of all previous government housing beneficiaries, against which the list of possible proclamation beneficiaries will be verified and validated.
Roles of the Agencies • DENR • Undertakes, upon written request by the HUDCC, the immediate conduct of the necessary boundary, topographic, structural or subdivision survey of the proclaimed area; • Approves the subdivision survey and plans; • Issues the corresponding special patent in case the proclaimed land is untitled; and • Issues the necessary permits and clearances for the development of the proclaimed site.
Roles of the Agencies • LGU • Creates a Local Housing Board or Office, or its equivalent, which when constituted shall function as the secretariat of the Local Inter-Agency Committee; • Provides the necessary fund to carry out its role and tasks under the Proclamation; and • Prevents and prohibits the entry of new settlers or occupants or the construction of new structures within the proclaimed site.
Roles of the Agencies • PCUP • Assists in the identification of the legitimate Non-Government Organization/People’s Organization (NGO/PO) which will represent the beneficiaries in the LIAC and its subcommittees; • Accredits urban poor organizations (HOA, CA, etc.) operating in the proclaimed area; and • Provides assistance in the conduct of social preparation activities and in the selection of beneficiaries.
Role of the Private Sector • NGO and PO • Assists the LIAC in all aspect of project planning, implementation, monitoring and evaluation.
Project Administration • Over-all coordinating agency: HUDCC • Land Administrator: Land-owner or DENR • 3. Project Administrator: • HUDCC • NHA • LGU concerned • National Government Agency or GOCC which administers or owns the proclaimed site
