Comprehensive Sexual Health Instruction California Healthy Youth Act Education Code Sections 51930-51939
Comprehensive Sexual Health Instruction (including HIV) is mandated
Purpose of this Act (1) Provide pupils with the knowledge and skills necessary to protect their sexual and reproductive health from HIV and other sexually transmitted infections and from unintended pregnancy. (2) Provide pupils with the knowledge and skills they need to develop healthy attitudes concerning adolescent growth and development, body image, gender, sexual orientation, relationships, marriage, and family. Section 51930
Purpose of this Act (3) To promote understanding of sexuality as a normalpart of human development. (4) To ensure pupils receive integrated, comprehensive, accurate, and unbiased sexual health and HIV prevention instruction and provide educators with clear tools and guidance to accomplish that end. (5) To provide pupils with the knowledge and skills necessary to have healthy, positive, and safe relationships and behaviors. Section 51930

Does not apply to: (a) This chapter DOES NOT apply to illustrations of human reproductive organs found in a text book, unless it includes other elements of CSE. (b) This chapter DOES NOT apply to instruction, materials that discuss gender, gender identity, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, or family and do not discuss human reproductive organs and their function. Education Code 220 No person shall be subjected to discrimination on the basis of sex, ethnic group identification, race, national origin, religion, color, mental or physical disability, or any actual or perceived characteristic [that is defined in] hate crimes [as defined in] Penal Code section 422.55 Penal Code 422.55 “Hate crime” means a criminal act committed, in whole or in part, because of one or more of the following actual or perceived characteristics of the victim: (1) Disability (2) Gender (3) Nationality (4) Race or ethnicity (5) Religion (6) Sexual orientation (7) Association with a person or group with one or more of these actual or perceived characteristics
Content of instruction for All pupils at least once in 7/8 and once 9-12: (1) Information on the nature of HIV, other sexually transmitted infections, and their effects on the human body. (2) Information on the manner in which HIV and other sexually transmitted infections are and are not transmitted. (3) Information that abstinence from sexual activity and injection drug use is the only certain way to prevent HIV and other sexually transmitted infections. “Abstinence from sexual intercourse is the only certain way to prevent unintended pregnancy.” Section 51934
Content of instruction for All pupils at least once in 7/8 and once 9-12: (4) Information on the effectiveness of all FDA approved methods that prevent or reduce the risk of contracting HIV or other STDs (including PrEP and HPV Vaccine) (5) Effectiveness of decreasing needle use and needle sharing (6) Treatment of HIV and other STDs, including how anti-retroviral therapy can prolong life and reduce risk of transmission (7) Societal views on HIV and AIDS. Section 51934
Content of instruction for All pupils at least once in 7/8 and once 9-12: (8) Information about local resources, how to access local resources, and pupils’ legal rights to access local resources for: • Confidential services • Sexual and reproductive health • Testing and medical care for HIV and other sexually transmitted infections • Pregnancy prevention and care • Assistance with sexual assault and intimate partner violence. (9) Information about the effectiveness and safety of all FDA-approved contraceptive methods in preventing pregnancy, including, but not limited to, emergency contraception. Section 51934
Content of instruction for All pupils at least once in 7/8 and once 9-12: Instruction on pregnancy shall include an objective discussion of all legally available pregnancy outcomes, including, but not limited to, all of the following: (A) Parenting, adoption, and abortion. (B) Information on the law on surrendering physical custody of a minor child. (C) The importance of prenatal care. Section 51934
Content of instruction for All pupils at least once in 7/8 and once 9-12: • (10) Information about sexual harassment, sexual assault, adolescent relationship abuse, intimate partner violence, and sex trafficking. Section 51934
Teacher training: • District shall provide HIV training for all district personnel teaching sexual health • District shall cooperate and collaborate with teachers in developing the training • Periodic training will be conducted on new developments in HIV. Shall be voluntary for personnel who demonstrate expertise • District may expand training to cover the topic of comprehensive sexual health Section 51935
Outside Consultants: • District may contract with outside consultants or guest speakers to deliver comprehensive sexual health education and HIV prevention education or to provide training for district personnel. • All outside consultants and guest speakers shall have expertise and knowledge of most recent information. Section 51936
Parent notification: • Parent/guardian has the right to excuse their pupil from all or part of comprehensive sexual health education and related assessments through a passive consent (opt-out). District shall not require active consent (opt-in). • At the beginning of the year, when a student enrolls after the beginning of the year districts shall notify parents about instruction planned for the coming year. Section 51938
