Major Issues since last time Content of basic OPS regulation Will essential requirements of 1592/2002 suffice for light aviation (non-complex) or must there be a set of light implementing rules (OPS 0)? The working group recommended the first option - EASA goes for the latter How to deal with small operators that used to be non-commercial but now might fall in the commercial category
Def: Commercial Operation "commercial operation" means any operation of an aircraft, against remuneration or other valuable consideration, which is available to the public or, when not made available to the public, which is performed under a contract between an operator and a customer, where the latter has no control over the operator;
Open questions... Where will flying club activities and “trial lessons” fall No simple answer – depends on how the club or operator is organized There is a risk that some operations that used to be non-commercial will now be considered commercial - particularly “trial lessons” and “sightseeing flights”
Requirements for any commercial operation (1592/2002 proposal) Submit a declaration of activities and means Implement & maintain a management system Establish and maintain an accident prevention and safety programme, including an occurrence reporting programme Operations Manual Procedures for disruptive passengers Security programme: Security of flight crew compartment, aircraft search procedure checklist, security training programmes etc. Fatigue Management System
MDM.032 suggests a light Commercial Operators Certificate. Licensing aspects will be crucial Is a CPL required to do a “trial lesson” or a “sight-seeing flight” No requirement for a CPL anywhere in basic EU regulation (1592/2002) Eventually the FCL group will decide
LAPL Licensing Subgroup Introduce a LAPL and a restricted LAPL without cross-country No Instrument Rating Instructor Qualifications – PPL level required. Medical issued by General Pratitioner
