  18. Capitalisation of experiences.. • Partners have long and rich experiences in a wider co-operation area, involving similar institutional structures from national to local level. (Entities based on a private law and private international law are already well experienced and functioning without problems) • - Responsibilities and competencesfor territorial cooperation are spread among all levels defined by partner’s political systems in place(Departments for External Relations, Sectoral Departments, Programme Authorities..).

Viability of establishing “EGTC” • New challenge offered by the EU regulation, allowing public authorities to create cooperative groups with legal personality with the added bonus that it would genuinely be joint: • directly applicable, binding instrument • provides simplification of procedures, a tool to overcome • legislative and organisational problems • permits the stipulation of agreements involving Member States

Shaping the “EGTC” in AAP territory • The institutionalisation of a trans-national public law body requires • the adoption of national provisions for effective application of Regulation No 1082/2006 on a European Grouping of Territorial Cooperation • Convention/Statute finalised on the basis of political consensus (according to the agreed type of an “EGTC”)
