The European Convention on transfrontier television And its future
The Convention (ECTT) • Guiding principle Freedom of reception and retransmission of programme services which comply with the terms of the Convention (Article 10 ECHR and Article 4 ECTT) • Purpose Facilitate the transfrontier transmission and retransmission of television programme services by establishing common basic standards (Article 1 ECTT) • States Parties: 31 • Entry into force: 1 May 1993
An open instrument • ECTT: a binding legal instrument prepared by the Council of Europe in 1989, first updated in 1998, presently in revision • Adapts to technological and economic changes (article 23 ECTT) • Non-member states of the CoE may accede (article 31 ECTT)
Common minimum standards • Protection of certain individual rights • Responsibilities of the broadcaster • Advertising and tele-shopping • Sponsorship
I. Protection of individual rights • Right of reply (art. 8) • Access of the public to information (art.9 ) • Access to events of major importance (art.9a)
II. Responsibilities of the broadcaster in programming matters (art.7) • Respect of the dignity of the human being and the fundamental rights of others (Prohibition of indecency, pornography, undue prominence to violence or incitement to racial hatred) • Protection of minors • Fair presentation of facts and events in newsprogrammes
III. Advertising and tele-shopping • General standards (consumer protection, child protection, no editorial influence by advertiser) (art.11) • Duration, form and presentation (art.12/13) • Insertion in and between programmes (art.14) • Particular products (tobacco, alcohol, medicines) (art.15)
IV. Sponsorship • General standards • Prohibited sponsorship
The Standing Committee on Transfrontier Television (T-TT) • Is responsible for applying and interpreting the Convention • Issues recommendations and opinions • Gives an opinion on lists of events of major importance drawn up by Parties • May settle disputes between Parties • Proposes amendments to the Convention
Composition of the T-TT • Members: delegations of States Parties (31) • Observers: delegations of other CoE member States and of the European Community • Upon invitation: Experts and any national or international governmental or non-governmental body
Why change the ECTT? • Rapid change in the media landscape • Development of on-demand audiovisual media services • Amendment of the EU TVWF Directive
Basis for change to the ECTT • Harmonisation with the future EU Audiovisual media services Directive • Introduction of specific CoE areas of concern
What will change? • The scope and title • The norms: additional norms on on-demand services on product placement and others under discussion • The working methods of the Standing Committee
