UUD 1945 Constitution • The constitution established by PPKI on August 18, 1945 • Consist of preamble, articles (16 chapters, 37 articles, 4 transitional provisions, 2 additional provisions) • Form of state: unitary ( in Paragraph 1, article 1), which stated “The state of Indonesia shall be a unitary state, with the form of republic.” Unitary means that the state sovereignty is not divided. • As Indonesia has many regions, those regions divided into 8 provinces
UUD 1945 • Form of government: Republic, shown in the way of electing the government leaders, which is elected by people in person or by proxy. • System of government: presidential, according to the provision of Article 4, paragraph (1) and Article 17 paragraph (1), (2), (3) • Read more detail in the copy of material Chapter 3, page 41,43,45 (English version), 40,42,44 (Indonesian version)
UUD 1945 • Changes in UUD 1945 – from Presidential to Parliamentary Government System: • November 11,1945 KNIP (KOMITE NASIONAL INDONESIA PUSAT) suggested to the President Sukarno that ministers/cabinet should not accountable to President, but to the parliament (KNIP), with these two reasons: a. The 1945 Constitution did not prohibit or require the minister to be responsible to parliament b. The ministerial accountability to parliament is a way to enforce people sovereignty
UUD 1945 • On November 14, 1945, the President issued a Notice of Government to approve the changes. • However, on 29 June – 2 Oct 1946 parliament changed back to presidential, because of event that endangers the country, so the president takes over the government. After normal circumstances, it returned back to presidential • On 27 June 1947, president took control of the government again, because General Spaar would attack Indonesia. This situation last for one week.
Changes from UUD 1945 to RIS (Federal Republic of Indonesia) • After the proclamation of independence, Dutch still wanted to colonize Indonesia. Again the Dutch entered Indonesia, and applied devide et impera politics by establishing a puppet states named BFO, resulted a dispute between Dutch and Indonesia. • Round Table Conference, 23 Aug – 2 Nov 1949, settle the disputes, and resulted in: a. Establishing RIS (Federal Republic of Indonesia) b. Recognizing popular sovereignty by the Dutch to RIS c. Establishing a union between RIS and Dutch
RIS (Federal Republic of Indonesia) Constitution • The RIS Constitution came into effect since 27 Dec 1949 • Consist of preamble, 197 chapters and appendix. • Form of state: federation or union, which consist of 7 states, 9 unit of states, and 1 residency. (see page 50 – Ind version, page 51 English version) • Form of Government: republic • System of Government: Parliamentary
Changes from RIS Constitution to 1950 Constitution • Since there was still desire to form a unitary state, on 8 March 1950, the Federal Government issued Emergency Law no 11 of 1950, on Procedure to Change the Composition of State for the State Region of the RIS, from many states changed to only 3 states. • Next week review on UUDS 1950 & UUD 1945
