Key changes: • Full statement of case with appeal • Draft statement of common ground with appeal (hearing/inquiry) • Fast track procedures for adverts and shopfronts Came into effect on 1st October 2013
Proposed PD changes in April 2014 Government consultation issued on 6th August.https://www.gov.uk/government/consultations/greater-flexibilities-for-change-of-use • Change from retail to dwellings • Change retail to banks / building societies • Agricultural building to dwellings • Change of use to nurseries providing childcare • Agricultural building to education use All except 2 above will have new prior approval application requirements.
Review of planning practice guidance http://planningguidance.planningportal.gov.uk/ • New draft guidance published on 28 August. CLG indicated would go live in the Autumn. • Condenses 230 documents and 7000 pages. • Introduces new guidance where there were gaps.
Use of materials in Rutland The NPPF says, 60. Planning policies and decisions should not attempt to impose architectural styles or particular tastes and they should not stifle innovation, originality or initiative through unsubstantiated requirements to conform to certain development forms or styles. It is, however, proper to seek to promote or reinforce local distinctiveness. • My emphasis on last paragraph. Reflects comments we’ve had from Members at Committee. • Rutland does have distinctive use of materials. • Some recent development uses materials that diminish this distinctiveness.
Extensions of time to determine applications • Planning Guarantee introduced by Government • Need to obtain agreement if applications not determined within 26 weeks
Sustainable Urban Drainage (SuDS) update • DEFRA committed to 6.4.14 introduction. Decision with politicians. • Rutland will be SAB • Probable Peterborough will process these applications • Will initially affect all major applications • Peterborough will advise against combined applications • Permeable roads and drives with no gullies or pipes will be part of solution • Peterborough approach is that principles agreed in pre-app with them and shown in planning application. Application to SAB is then akin to a S.38 application once PP granted. • www.peterborough.gov.uk/suds for more information.
Conservation Area Consents • They are no longer required • Now replaced by a planning application instead • Will mean no need for 2 applications • Forms adapted on Planning Portal • Took effect on 1.10.13.
Revised Local List of application requirements • Updated list on our website • Jointly prepared with Leicestershire authorities • Key issue is local requirements are no longer mandatory • Planning staff advised on pre-apps to agree with you any that will be needed
Chancellors Autumn Statement Government to consult on Making changes of use easier from retail to restaurant and assembly and leisure uses Setting up a default that conditions are approved if no response within set period Strengthen requirement to justify conditions Removing any S106 requirement for affordable housing on less than 10 dwellings
