Conditions Condition #2: Prior to initiating any construction on the site, EPD must receive a letter of verification from TM-Econ Mitigation Bank, stating that the transaction regarding the transfer of a total 1.11 mitigation credits has been completed; or a letter of verification from Shingle Creek or Reedy Creek Mitigation Bank, stating that the transaction regarding the transfer of a total of 0.25 UMAM credit has been completed. In lieu of these two options, the applicant may propose additional alternative mitigation that meets the requirements of Chapter 15, Article X. Condition #4: This permit requires, prior to the commencement of construction activities within wetlands, the recording of a conservation easement in the public records of Orange County for the remaining onsite wetland on Lot 26 and Lot 27 (for a total of at least 0.45 acre), when applicable, notation of the conservation easement on the corresponding plat. The conservation easement shall be dedicated to Orange County and shall include restrictions on the real property pursuant to the requirements set forth…
Conditions Modified Condition #3: In the event that the permittee does not successfully complete the transaction to obtain the appropriate credits from a mitigation bank approved by EPD, the permittee shall obtain a permit modification to provide alternative mitigation for the wetland impacts prior to commencement of construction activities to be approved by EPD. Modified Condition 10: This permit conveys approval for the wetland impacts only. This permit cannot be relied upon as an approval of any other required regulation from any other federal, state, and local rules and regulations.
