  2. ARMY SEXUAL ASSAULT POLICY • Sexual assault is a criminal offense that has no place in the Army. It degrades mission readiness by devastating the Army’s ability to work effectively as a team. Every Soldier who is aware of a sexual assault, should immediately (within 24 hours) report incidents of sexual assault. It is incompatible with the Army Value and is punishable under the Uniform Code of Military Justice (UCMJ) and other local civilian laws.

WHAT IS SEXUAL ASSAULT • Rape – sexual intercourse by force and without consent • Forcible sodomy – oral or anal sex by force and without consent • Indecent assault – any non-consensual touching done with intent to gratify lust or sexual desires • Carnal knowledge – sexual intercourse with a minor

WHAT IS THE ARMY’S SEXUAL ASSAULT POLICY • The Army policy on sexual focuses on: • Sexual assault as a punishable criminal offense • Use of training, education, and awareness for prevention • Promoting sensitive handling of victims • Requiring aggressive , timely, and thorough investigation • Holding offenders accountable • Treating all victims with dignity, fairness, and respect

  5. CONSENT • “Consent” shall not mean the failure by the victim to offer physical resistance. Consent is not given when a person uses force, threat of force, coercion or when the victim is asleep, incapacitated, or unconscious. Prior consent does NOT imply present consent.

  6. HOW CAN I HELP MY SOLDIER AFTER A SEXUAL ASSAULT HAS OCCURED • Keep all info confidential and disclose info only to those who have an official need to know. Don’t make judgments about the victim or the alleged offender. Show respect and demonstrate empathy. Remember it is normal for survivors to experience a range of feelings after a sexual assault. Each person will react differently to a traumatic event; there is no “right” or “wrong” way to feel. • Bottom line: Support the Soldier.

REPORTING OPTIONS • An active duty victim has two reporting options: • Restricted Reporting – sexual assaults can be reported to the Sexual Assault Response Coordinator, health care professionals, Victim Advocates, and chaplains without law enforcement or legal being notified. The Garrison Commander is the only commander notified with non-identifying information regarding the assault, the victim, and offender.

  8. REPORTING OPTIONS • Unrestricted Reporting – sexual assaults reported as above with identifying information to command as well as notifying law enforcement and legal.

TIPS ON REPORTING OPTIONS • Restricted reporting is only available to Military members. • Restricted reporting is not an option for marital sexual assault. • Regardless of how you hear about a sexual assault remember to ensure victim safety and that appropriate reporting agencies are notified but do not initiate an internal investigation.

  10. RIGHTS OF THE VICTIM • Crime victims have the following rights: • To be treated with fairness dignity, and a respect for privacy • To be reasonably protected from the accused offender • To be notified of court proceedings • To be present at all public court proceedings related to the offense • To confer with legal counsel • To information regarding conviction, sentencing, imprisonment and release of the offender from custody

ARMY SEXUAL ASSAULT PREVENTION & REPORTING PROGRAM • Prevention • Rely on your instincts and be watchful • Use the buddy system • Establish and maintain your limits • Avoid alcohol and drugs • If you are sexually assaulted • Contact the authorities • Do not “clean up” • Call a friend • Go to a hospital or clinic and have the personnel contact the authorities
