MAgNA CARTA- 1215 • John became King in 1199 when his brother, King Richard I died. • He was cruel, greedy, and failure as a King • He lost a lot of land in France in 1205 and for the rest of his life tried to fight to get the land back • He kept raising taxes to pay for wars • The nobles had enough of paying taxes • Made him sign the Magana Carta- “The Great Charter”
Magna carta- cont’d • Vital piece of English history where the rights of people are protected against the power of the king or queen • Important points: • The Church had the final say who was appointed to Church positions of power. • The King was not allowed to demand more and more money from his nobility • Everyone has the right to a fair trial
Petition of right- 1628 • King Charles I abusing his power. • He quartered troops in people’s houses • Arrested people that went against him • Parliament made him agree to Petition of Right before giving him any more money • Important Points: • No troops could be quartered in people’s houses • No taxes without Parliament’s approval • No person can be jailed without reason
English bill of rights- 1688 • The rules included: • Trial by jury • Due Process • No cruel punishment • No excessive fines or bails • Right to bear arms • Right to petition the gov’t
Social Contract theory • In a state of nature there would be no way to protect your rights, if someone was bigger, stronger, faster, or smarter than you they could easily deprive you of life, liberty, or property.
Social Contract theory • To correct this, we institute gov’t. • Under gov’t, a society agrees to give up some of their rights so that the gov’t can make and enforce laws that protect all of our natural rights.
Social Contract theory • Gov’t is created by the consent of the governed. • When a gov’t begins to infringe on the natural rights of citizens……then the citizens have the authority to amend or abolish the gov’t
