OEA - Background Information • Created in 1985 • Agency of the MOL, and independent of the WSIB • 3 Intake Advisers and 16 Regional Employer Specialists • Fully funded by employer WSIB premiums (no additional fees/charges for our services!) • Established to provide employers with confidentialadvice, education, and representation on all WSIB matters
OEA Service Focus • Provide the employer community with professional, reliable, expert information and timely assistance • Attempt to resolve disputes before they reach the formal hearing stage • Ensure employers receive fair treatment
Advisory Services • Immediate advice available via 1-800-387-0774: - Intake Advisers provide timely advice and information - Complex cases are referred to a regional Employer Specialist for follow up • Avoiding costly mistakes and penalties • Knowing your rights & obligations • Avoiding penalties or prosecution by WSIB
Representation Services • Representation for most employers (ie, primarily those with less than 100 workers) before the WSIB Operations and Appeal Branch, as well as WSIAT • Promoting the use of alternative dispute resolution (ADR) mechanisms, when possible • Services are available in both official languages
Educational Services • “E-bulletin” e-mail newsletters informing employers of WSIB policyand procedural changes 5-6 times per year • Information on our web site: www.employeradviser.ca • Fact sheets • Employer Guides available for both Construction and Non-Construction Sector employers • Practical tools for employers on web site
Basic life of a WSIB claim • Day of Injury (health care, investigation, Form 7) • Return-to-work (written offer of suitable modified work) • Use of Functional Abilities Form and WSIB Return To Work Specialist • SIEF, Cost Transfer or 3rd Party Cost Relief possible? • Work Reintegration (combines RTW, Re-employment and Labour Market Re-entry): a breach = financial penalties! • Appeals (Operations, Appeals Branch, and WSIAT) • Final Tip: Document, Document, Document!
