  1. Western States Petroleum Association Cumulative Impacts of Pollution Contra Costa County Hazardous Materials Commission Michaeleen Mason Western States Petroleum Association December 4, 2008

  2. Western States Petroleum Association • WSPA – oldest US petroleum trade association • Formed in 1907 • Twenty-seven companies: exploration, production, transportation, refining and marketing • Six states: California, Washington, Oregon, Nevada, Arizona, Hawaii • Seven offices • Twenty employees 2

  3. Western States Petroleum Association Western States Petroleum Association Western States Petroleum Association Cumulative risk: concepts to consider • California regulates stationary and mobile sources as stringently as any state in the U.S. • California residents benefit from some of the most advanced environmental controls found in the world. 3

  4. Western States Petroleum Association Western States Petroleum Association Western States Petroleum Association Cumulative risk: concepts to consider But… • California is the most highly populated state in the U.S. • Within 10 years, California may be home to one in every 7 U.S. residents • Despite the progress made to date and stringent environmental controls, challenges to control emissions and environmental impacts remain 4

  5. Western States Petroleum Association Cumulative risk: concepts to consider Let’s consider where we are now so that we can think about where we can go when considering how to address cumulative impacts in in a regional setting 5

  6. Western States Petroleum Association Cumulative risk: background Key environmental regulations • California Environmental Quality Act (CEQA) • AB 2588 Air Toxics Hot Spots Program (1987-Connelly) • AB 3777 – Risk Management and Prevention Plans for Acutely Hazardous Materials • ARB portfolio of diesel regulations • Local environmental regulations (regional boards, city and county planning commissions, and air pollution control districts, air quality management districts) 6

  7. Western States Petroleum Association Cumulative risk: can more be done? Despite the multiple layers of environmental controls that exist, are there other mechanisms that could be developed to further control cumulative risks? 7

  8. Western States Petroleum Association Cumulative risk: can more be done? A framework for consideration: • New sources should be permitted with the cleanest, most effective and most efficient emission controls • All existing sources should be controlled to the best available retrofit controls appropriate to the source • Transportation sources (autos, trains, boats, off-road vehicles, construction equipment, airplanes) should also reduce emissions to lowest levels feasible • Controls and clean up should not be punitive • All sources should contribute to reducing cumulative impacts • A robust evaluation process is essential 8

  9. Western States Petroleum Association Cumulative risk: can more be done? Conclusion: We cannot force the most recent permit applicants to clean up the cumulative impacts of the past
