  1. A A B Brief rief A About Probate Guardianship bout Probate Guardianship Probate Guardianship is the appointment of an adult (by a court), who is not the child's parent, to take care of the child or his/her property. Probate guardianship can be divided into two types: probate guardianship of the person and probate guardianship of the estate. A probate guardianship of a person is appointed by the court to give the person living with the kid, the legal power to decide on behalf of the kid. The guardian has to take care of the child and provide with necessary things. He/she should also protect him/her and help the child to grow both physically and mentally. On the other hand, a Guardianship of the estate administrates over a child's estate until he/she turns 18. The guardian should maintain the financial record that has to be presented at court. He/she should also manage the funds, collect as well as make an inventory of the assets. You can hire a Houston probate lawyer for the purpose. Under Texas law, Guardianship arrangements can be legally dignified through the Houston Probate court system. The arrangement requires at least 4 persons that are - a proposed guardian, a proposed ward, an attorney ad litem, or a person who shall represent the interests of the proposed ward, and a Houston probate court. It would be better if the proposed guardian also hires an experienced guardianship Houston probate lawyer, but it is not necessary. Now let us know who can be a proposed ward. A proposed ward might be -  A minor  An orphan  A mentally or physically handicapped adult

  2.  An incapable elderly person A formal procedure has been decided by the Texas guardianship law for assigning a guardian. Firstly, the proposed guardian has to submit a guardianship application and a letter from a doctor confirming that the proposed ward is incompetent to decide on his own. He/she should sum it at the Texas probate court. Then an attorney ad litem will be selected by the court, who shall represent the ward. Then a guardianship hearing will be scheduled by the court, where the proposed guardian shall take an oath promising to follow his/her duties towards the proposed ward. He/she shall also post a bond according to the requirement. If the bond specifies that he/she is a guardian of the estate, there may be post- hearing held.
