If you are a commercial driver who is subject to the DOT controlled substances and alcohol testing regulations, you should be aware of the prohibitions under 49 CFR Part 382. These prohibitions are designed to prevent the misuse of alcohol and the use of controlled substances by drivers.

  2. 49 CFR Part 382 prohibits drivers from engaging in any of the following activities: Having an alcohol concentration of 0.04 or higher while performing safety-sensitive functions, such as driving, inspecting, or repairing a CMV. Using alcohol within four hours before performing safety-sensitive functions, or while on duty or call. Using alcohol within eight hours after an accident, or until tested, whichever comes first. Refusing to submit to a required alcohol or drug test. Using any controlled substance at any time, unless prescribed by a licensed medical practitioner who is familiar with the driver’s medical history and job duties. Testing positive for any controlled substance. Failing to report any use of alcohol or controlled substances to their employer.
