Strategic Growth Council DGS Site Selection Authority 1. Property Acquisition Law Government Code Section 15850 et. sec. 2. State Public Works Board (SPWB) Authority to select and acquire Real Property on behalf of the State with the consent of the State Agency (Client) concerned.
State Administrative Manual (SAM) 6849 (Process Guidelines) Site selection and acquisition (SPWB’s Role) DGS acts as agent or staff to SPWB Site selection is program driven and authorized by the Legislature based upon 5 Yr. Facility Plans and Capital Outlay Budget Change Proposal (COBCP) approvals.

Site Selection Process Program Need – Requirements • Service to be provided (use of facility) • Geographical area to be served • Special location issues* • Size of land area needed • Topography , access, soil conditions • Zoning, General Plan (local) • Transit, Parking, Utilities • Environmental issues (CEQA) • * Some special location considerations • Freeway access – unimpeded (RR Tracks) • Line of sight – Emergency Vehicles • Radio Transmissions Requirements (Tower) • Avoidance of high traffic areas (Schools) • Setbacks ( Dept. of Defense) • Very large or remote parcel • Appropriate for fuel storage
Sometimes Sites are pre-selected. • Legislative Decision (Site authorized by special legislation) • Site specific requirements (Necessity to locate adjacent property) • Multiple site assemblages (Project requires more than one parcel) • Land exchange or exercise of an option (Fulfilling a previous agreement)
Site Search • Initial considerations • Co-location options (State/Federal/Local Government) • Surplus State Property • Local Government Surplus • Re-use, Infill, Brownfield options If no opportunities are found, continue search of the land market Identify site options. Assemble information package on potentialsites (3-5 sites). Plan site tour with team which includes DGS Environment Planning (ESS) and State Agency Client. Identify priorities, evaluate which sites best meet Client needs and rank the sites.
Site Specific Study • Begin initial title, value and CEQA study on top site priority. • Review preliminary report. Get approved appraisal and preliminary environmental investigations. • If no significant title or environmental issues are found and site value is within budget appropriation, prepare for SPWB site selection approval. • If not, begin study on 2nd site priority. Proceed until a site is successfully selected. • To complete Acquisition phase, financial and contract terms must be agreed to with “Seller”.
