The Skinny on the ACT Enacted by President Clinton on October 1, 1996 Purpose: Encourage donation of food and grocery products to non-profit organizations for distribution to  individuals in need This law: Protects you from liability Protects you from civil and criminal liability Standardizes donor liability exposure Sets a floor of "gross negligence" or intentional misconduct for persons who donate grocery products Gross negligence - voluntary and conscious conduct by a person with knowledge (at the time of conduct) that the conduct is likely to be harmful to the health or well-being of another person
  8. FOOD LEFTOVERS CLAUSE COMPANY would like to donate all leftovers to local charity. The Bill Emerson Good Samaritan Food Donation Act protects donors from liability when donating to a non-profit organization. It protects donors from civil and criminal liability should the product donated in good faith later cause harm to the needy recipient. It standardizes donor liability exposure.   9. FOOD DONATION CLAUSE Should COMPANY not meet the minimum requirement for food and beverage, COMPANY will purchase food from the hotel in the amount of the unused food and beverage minimum and donate it to a local charity. COMPANY shall take a tax deduction from the chosen food bank.

GENERAL DONATION GUIDELINES Food must be within Code date Food has not been reheated Refrigerated food has been prepared within 48 hours of donation Buffet food has been served by your employees and not set out for public self–service Containers have been labeled with the preparation date, ingredients, potential allergens and any special instructions Each type of food has been packaged separately Packaged meat that is donated through the Retail Rescue initiative must have been frozen prior to its expiration date to ensure food safety and extend the shelf life of the meat All food must be maintained in safe temperature zones
