Subsidies Agreement • Subsidies Agreement disciplines use of subsidies, and regulates actions countries can take to counter effects of subsidies.
Subsidies Agreement Agreement defines three categories of subsidies: • Prohibited; • Actionable; and • Non-actionable (lapsed on 31 December 1999)
Subsidies Agreement • SCM Agreement applies to all products, unless otherwise stated, including fish and other aquatic products, be they from marine or inland fisheries or aquaculture.

Fishery Subsidy Negotiations Paragraph 28 DD: participants shall aim to clarify and improve WTO disci-plines on fisheries subsidies, taking into account importance of this sector to developing countries.
Fishery Subsidy Negotiations • On the negotiating table: • 11 discussion papers by six countries or groups of countries. • 6 negotiating proposals by five countries.
Fishery Subsidy Proposals US proposal • Red category: subsidies that "directly promote overcapacity and over-fishing, or have other direct trade-distorting effects". • Dark Amber category: subsidies presumed to have harmful effects on overcapacity/over-fishing or adverse trade effects unless demonstrated otherwise
Fishery Subsidy Proposals • EC proposal • Prohibited subsidies: those which enhance fishing capacity; • Green subsidies: those which are linked to capacity reductions or intended to mitigate the social and economic consequences of restructuring.
Doha Development Round • Negotiations resumed in March 2004. • Deadline still end of 2004. • New or elaborated “old” proposals expected in fisheries. • Intensive programme of informal meetings for rest of 2004..
