To be valid the Will must comply with the formal requirements of the Wills Act 1837 as substituted by the Administration of Justice Act 1982. There are certain people who should not be witnesses i.e. people who are drunk or of an unsound mind. Also, the witness must be over the age of 18 and not related to either the Testator or Testrix or be a beneficiary of the Will. We recommend that the witness is not a spouse or partner to anyone who is due to inherit.

Intestacy Law If you are a resident of England and Wales and die without having made a legally valid Will or a Will that has partially failed in some way, your estate becomes subject to the Rules of Intestacy. The Rules of Intestacy determine how your estate is to be distributed after the payment of all your debts and liabilities, testamentary expenses and funeral costs.
